Case Overview and Summary
Life Pension for Auditor General and COMELEC Officials- Auditor General, COMELEC Chairman or Member who retires after completing term, becomes incapacitated, dies in service, or resigns at 60 years old shall receive lump sum payment of 5 years' salary if they rendered at least 20 years of government service. (Section 1)
- Former officials who meet the qualifications prior to this Act shall also receive benefits, but must refund any previous gratuity or pension received, and benefits will only accrue from the Act's approval date. (Section 2)
- Officials who avail of this Act cannot retire under RA 660 or other retirement laws, but can claim refund of personal retirement premiums paid to GSIS with interest. They can still receive GSIS life insurance benefits. (Section 3)
- Benefits are tax-exempt and cannot be garnished, levied or executed. (Section 4)
- Funds are appropriated from the National Treasury as permanent annual appropriations. (Section 5)
- Act took effect upon approval on June 16, 1956. (Section 6)

AN ACT TO PROVIDE LIFE PENSION TO THE AUDITOR GENERAL AND THE CHAIRMAN OR ANY MEMBER OF THE COMMISSION ON ELECTIONS.
Section 1. When the Auditor General, or the Chairman or any Member of the Commission on Elections retires from the service for having completed his term of office or by reason of his incapacity to discharge the duties of his office, or dies while in the service, or resigns upon reaching the age of sixty years, he or his heirs shall be paid in lump sum his salary for five years: Provided, That at the time of said retirement, death or resignation, he has rendered not less than twenty years of service in the government.
Section 2. Any living former Auditor General, or Chairman or any Member of the Commission on Elections, whose term of office has ceased, or has retired or resigned, or been incapacitated to discharge the duties of the office, prior to the approval of this Act, shall also be entitled to the benefits of this Act...
