AN ACT PREVENTING AND PENALIZING CARNAPPING
Section 1. This Act shall be known and may be cited as the "Anti-Carnapping Act of 1972."
Section 2. Definition of terms. The terms "carnapping", "motor vehicle", "defacing or tampering with", "repainting", "body-building", "remodeling", "dismantling", and "overhauling", as used in this Act, shall be understood, respectively, to mean
"Carnapping" is the taking, with intent to gain, of a motor vehicle belonging to another without the latter's consent, or by means of violence against or intimidation of persons, or by using force upon things.
"Motor vehicle" is any vehicle propelled by any power other than muscular power using the public highways, but excepting road rollers, trolley cars, street-sweepers, sprinklers, lawn mowers, bulldozers, graders, fork-lifts, amphibian trucks, and cranes if not used on public highways, vehicles, which run only on rails or tracks, and tractors, trailers and traction engines of all kinds used exclusively for agricultural purposes. Summary of Republic Act No. 6539 (Anti-Carnapping Act of 1972):
Definitions:
- "Carnapping" is the taking of a motor vehicle belonging to another without consent, or by violence, intimidation, or force. (Section 2)

- Owners of motor vehicles in all cities and municipalities must register their cars with the local police. (Section 3)
- The Land Transportation Commission shall keep a permanent registry of motor vehicle engines, engine blocks, and chassis, including their type, make, serial numbers, and owner information. (Section 4)
- Any sale, transfer, conveyance, substitution, or replacement of a motor vehicle engine, engine block, or chassis must be registered with the Land Transportation Commission. (Section 5)
Registration Process:
- For original registration of a motor vehicle, the applicant must apply to the Philippine Constabulary for clearance within one week after assembly, rebuilding, or acquisition. (Section 6)
- The Philippine Constabulary will verify if the motor vehicle or its parts are not in the list of carnapped or stolen vehicles, and issue a certificate of clearance. (Section 6)
- Upon presenting the clearance certificate and verification of registration, the Land Transportation Commission shall register the motor vehicle. (Section 6)
Duties of Importers, Manufacturers, and Transporters:
- The Collector of Customs must report the arrival of imported motor vehicles or parts to the Land Transportation Commission within seven days. (Section 7)
- Importers, distributors, and sellers of motor vehicles must keep a permanent record of their stocks and report monthly transactions to the Land Transportation Commission. (Section 8)
- Manufacturers of engine blocks, chassis, or bodies must cause numbering and submit monthly reports to the Land Transportation Commission. (Section 9)
- Clearance and permit are required for assembly or rebuilding of motor vehicles from the Philippine Constabulary or Philippine Coast Guard. (Section 10)
- Inter-island shippers must report motor vehicles or parts transported to the Philippine Constabulary within seven days. (Section 11)
Prohibitions and Penalties:
- It is unlawful to deface or tamper with the original or registered serial numbers of motor vehicle engines, engine blocks, and chassis. (Section 12)
- Violations of the Act are punishable by imprisonment of two to six years and a fine equal to the acquisition cost of the motor vehicle or part involved. (Section 13)
- For carnapping without violence or intimidation, the penalty is imprisonment of fourteen years and eight months to seventeen years and four months. (Section 14)
- For carnapping with violence, intimidation, or force, the penalty is imprisonment of seventeen years and four months to thirty years. (Section 14)
- If the owner, driver, or occupant is killed during carnapping, the penalty is life imprisonment to death. (Section 14)
- Aliens convicted under the Act shall be deported immediately after serving their sentence. (Section 15)
Rewards and Informers:
- Persons who voluntarily provide information leading to the recovery of carnapped vehicles and conviction of offenders shall be given a reward by the Philippine Constabulary. (Section 16)
- Information given by informers shall be treated as confidential. (Section 16)
Other Provisions:
- A separability clause is included. (Section 17)
- Inconsistent laws, executive orders, rules, and regulations are repealed or amended accordingly. (Section 18)
- The Act took effect upon its approval on August 26, 1972. (Section 19)
