REPUBLIC ACT No. 10586
AN ACT PENALIZING PERSONS DRIVING UNDER THE INFLUENCE OF ALCOHOL, DANGEROUS DRUGS, AND SIMILAR SUBSTANCES, AND FOR OTHER PURPOSES
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. Short Title. – This Act shall be known as the "Anti-Drunk and Drugged Driving Act of 2013″.
Section 2. Declaration of Policy. – Pursuant to the Constitutional principle that recognizes the protection of life and property and the promotion of the general welfare as essential for the enjoyment of the blessing of democracy, it is hereby declared the policy of the State to ensure road safety through the observance of the citizenry of responsible and ethical driving standards.

Summary of Republic Act No. 10586 (Anti-Drunk and Drugged Driving Act of 2013)
Declaration of Policy (Section 2)
- Ensure road safety through responsible and ethical driving standards.
- Penalize driving under the influence of alcohol, dangerous drugs, and other intoxicating substances.

Definitions (Section 3)
- Defines terms such as alcohol, breath analyzer, chemical tests, dangerous drugs, driving under the influence of alcohol/drugs, field sobriety tests, motor vehicle, public utility vehicle.
Driver's Education (Section 4)
- Applicants for driver's license must complete a course on safe driving, including effects of alcohol/drugs and penalties for violation.
- Written examination to include questions on alcohol/drug intoxication and legal consequences.
Punishable Act (Section 5)
- Unlawful to drive a motor vehicle while under the influence of alcohol, dangerous drugs, and/or other similar substances.
Conduct of Tests (Section 6)
- Law enforcement officer with probable cause can conduct field sobriety tests.
- If driver fails, officer must determine blood alcohol level using breath analyzer.
- If suspected drug influence, officer must bring driver for drug screening/confirmatory test.
Mandatory Testing after Accidents (Section 7)
- Drivers involved in accidents resulting in injury/death must undergo chemical tests for alcohol/drugs.
Refusal of Tests (Section 8)
- Refusal to undergo mandatory tests results in license confiscation and automatic revocation, plus other penalties.
Acquisition of Equipment (Section 9)
- LTO and PNP to acquire sufficient breath analyzers and drug-testing kits within 4 months, prioritizing high-accident areas.
- Funded by Special Road Safety Fund and annual appropriations.
Deputation (Section 10)
- LTO may deputize traffic enforcement officers to enforce the Act.
Law Enforcement Education (Section 11)
- LTO and PNP to conduct annual training seminars on field sobriety and breath analyzer tests.
- LTO to publish guidelines on field sobriety tests within 4 months.
Penalties (Section 12)
- Without injury/homicide: 3 months imprisonment, Php20,000 - Php80,000 fine.
- With physical injury: Higher penalty under Revised Penal Code or above, plus Php100,000 - Php200,000 fine.
- With homicide: Penalty under Revised Penal Code, plus Php300,000 - Php500,000 fine.
- License suspension for 12 months (first offense) or perpetual revocation (second offense for non-professional, first offense for professional).
Liability of Vehicle Owner/Operator (Section 13)
- Owner/operator of offending vehicle directly liable for fines and damages unless proven extraordinary diligence in driver selection/supervision.
- Applies principally to public utility and commercial vehicles.
Information Campaign (Section 14)
- PIA to conduct nationwide IEC campaign within 1 month after implementing rules.
Random Inspections and Drug Tests (Section 15)
- LTO to conduct random terminal inspections and quick random drug tests of public utility drivers.
