Summary of Executive Order No. 1052

Authorizing Abutting Landowners to Plant Fruit-Bearing Trees on Right-of-Way

- Allows abutting landowners to plant fruit-bearing trees on the right-of-way along national, provincial, and municipal/city roads integrated into the national and National-Aid Road Systems.
- The planting of trees is subject to the following conditions:
    - Trees must be planted at least 6 meters from the outer edge of the shoulder of the road. (Section 1)
    - Trees must not obstruct the view of the road for safety purposes. (Section 1)
    - Landowners are responsible for maintaining and pruning the trees. (Section 2)
    - Landowners have the right to harvest the fruits from the trees they planted. (Section 3)
    - The Department of Public Works and Highways (DPWH) may remove the trees if necessary for road improvement or maintenance, without obligation to pay compensation. (Section 4)
    - The DPWH shall promulgate rules and regulations to implement the order. (Section 5)
