EXECUTIVE ORDER NO. 109 July 1, 1986

AUTHORIZING THE COMMISSIONER OF INTERNAL REVENUE TO MONITOR, CHECK, SUPERVISE AND APPROVE ALL IMPORTATION OF BLENDING TOBACCO SUBJECT TO CERTAIN RULES, IMPOSING AN ADDITIONAL IMPORTED BLENDING TOBACCO INSPECTION AND MONITORING FREE, AND FOR OTHER PURPOSES

WHEREAS, the manufacture of cigarettes requires the use of various kinds of imported blending tobaccos to improve the quality of the said cigarettes;

WHEREAS, these imported blending tobaccos differ in qualities, come form different countries, and command prices that vary from time to time due to the demand of the market;

WHEREAS, it is important to keep strict and constant control over importation of these blending tobaccos not only because they affect the quality and price of cigarettes manufactured locally but also because such importations are easily the subject of manipulation and misdeclaration;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:

Summary of Executive Order No. 109

Authorizing the Commissioner of Internal Revenue to Monitor, Check, Supervise and Approve All Importation of Blending Tobacco

• The Commissioner of Internal Revenue is authorized to monitor, check, supervise and approve all blending tobacco importations. (Sec. 1)
• Before any importation of blending tobaccos, the price approval of the Commissioner of Internal Revenue must be secured. (Sec. 1a)
• The Commissioner must inform himself of the quantity, quality, price, source, and intended usage of the tobacco to be imported. (Sec. 1b)
• If the importation appears legitimate, the Commissioner shall notify the concerned government officer of his approval. (Sec. 1b)
• The appropriate government agency shall then proceed with the approval or disapproval of the importation according to existing laws, rules, and regulations. (Sec. 1c)
• The Commissioner shall monitor the importations and use of the tobacco to determine if the importer's representations are true and correct. (Sec. 1d)
• The Commissioner is authorized to collect an additional imported blending tobacco inspection and monitoring fee of P5.00 per kilo from every importer of tobacco. (Sec. 1e)
• This Executive Order covers all blending tobacco importations beginning July 1, 1986. (Sec. 2)
