Executive Order No. 181

EXECUTIVE ORDER NO. 181 June 1, 1987

AUTHORIZING THE REORGANIZATION OF THE CIVIL SERVICE COMMISSION AND ENHANCING ITS INDEPENDENCE; AND FOR OTHER PURPOSES

WHEREAS, under Article II, Section 1 of the Provisional Constitution, as adopted in Proclamation No. 3 dated March 25, 1986, the President shall give priority to measures to achieve the mandate of the people to completely reorganize the government;

WHEREAS, Article XVIII, Section 16, of the 1987 Constitution recognizes that the reorganization of the government shall be continued even after the ratification of the Constitution.

WHEREAS, under Article XVIII, Section 6, of the 1987 Constitution, the President shall continue to exercise legislative powers until the First Congress is convened;

WHEREAS, the independence of the Civil Service Commission as mandated under the 1987 Constitution must be enhanced to enable it to discharge effectively its powers and functions and thereby strengthen the career service;

Reorganization and Enhancement of Independence of the Civil Service Commission

- Reorganizes the Civil Service Commission to enhance its independence as mandated by the 1987 Constitution (Sec. 1)
- The Civil Service Commission shall be composed of a Chairman and two Commissioners (Sec. 2)
- The Chairman and Commissioners shall be natural-born citizens of the Philippines, persons of proven competence, integrity, and independence (Sec. 2)
- The Chairman and Commissioners shall be appointed by the President with the consent of the Commission on Appointments (Sec. 2)
- The Chairman and Commissioners shall have a term of seven years without reappointment (Sec. 2)
- The Chairman and Commissioners shall not be removed from office except for cause as provided by law (Sec. 2)
- The Chairman shall be the Chief Executive Officer of the Commission and shall exercise overall administration and supervision over the Commission (Sec. 3)
- The Commission shall have the following powers and functions: (Sec. 4)
    - Administer and enforce the constitutional and statutory provisions on the merit system
    - Approve and promulgate policies, standards and guidelines for the civil service
    - Promulgate rules, regulations and standards for the administration of the position classification and compensation system
    - Render opinions and rulings on position classification and all other civil service matters
    - Administer the nationwide selection process for admission to the career service
    - Exercise appellate jurisdiction over decisions and actions of its offices and regional offices
- The Commission shall be assisted by a Civil Service Commission Secretariat (Sec. 5)
- This Executive Order shall take effect immediately (Sec. 6)
