PRESIDENTIAL DECREE NO 1078

CONVERTING THE BASA AIR BASE COMMUNITY COLLEGE INTO THE PHILIPPINE AIR FORCE COLLEGE OF AERONAUTICS, PROVIDING FOR A CHARTER FOR THIS PURPOSE

WHEREAS, the Constitution of the Philippines directs the State to establish and maintain a complete, adequate, and integrated system of education relevant to the goals of national development and further prescribes that all educational institutions shall aim to develop scientific, technological and vocational efficiency;

WHEREAS, under Presidential Decree No. 6-A also known as the Educational Development Decree of 1972 promulgated on September 29, 1972, it had been declared a policy of the government to re-orient the educational system toward an accelerated national economic growth and meaningful social development;

WHEREAS, Basa Air Base Community College originally established with the approval of the Secretary of Education and Culture to cater to the educational needs of the military personnel of Basa Air Base, their dependents, and civilians residing in the surrounding communities has successfully brought into this rural area, college education at a minimal cost;

Conversion of Basa Air Base Community College into Philippine Air Force College of Aeronautics

- Establishes the Philippine Air Force College of Aeronautics by converting the Basa Air Base Community College. (Section 1)
- The College shall provide professional, vocational, and technical instruction in aeronautics, electronics, and supply management. It shall also promote research and advanced studies in these fields. (Section 2)
- The College may offer postgraduate courses in its fields of specialization, subject to financial and instructional facilities, and existing laws and regulations. (Section 3)
- The College shall be open to the public, without discrimination based on sex, ethnicity, or religion. Priority shall be given to residents of the PAF community responsible for the initial support and establishment of the college, if space is limited. (Section 4)
- The College shall have a Board of Trustees as its governing body, consisting of the Secretary of Education and Culture (Chairman), Commanding General of PAF (Vice-Chairman), Director of Bureau of Public Education, a representative of the Civil Aeronautics Administration, and the incumbent Director of Basa Air Base Community College (to be replaced by the College President upon appointment). (Section 5)
- The College shall be headed by a President, appointed by the President of the Philippines upon recommendation of the Board of Trustees. The President's salary or honorarium shall be fixed by the Board, subject to existing laws, and comparable to that of Presidents of similar educational institutions. (Section 6)
- The President shall have the powers and duties usually pertaining to the Office of the President of a University. (Section 7)
- Until a President is appointed, the Director of Basa Air Base Community College shall act as the Officer-in-Charge. The existing faculty and personnel shall be absorbed by the new college, with salaries adjusted by the Board, subject to existing laws and regulations. The college shall absorb all properties, assets, and liabilities of the former Basa Air Base Community College. The present compound and buildings shall continue to be used by the college on loan basis from the Philippine Air Force. (Section 8)
- A quorum of the Board of Trustees shall consist of a majority of all members holding office at the time a meeting is called. All processes against the Board shall be served on the President or Secretary thereof. (Section 9)
- The members of the Board of Trustees shall be entitled to an allowance comparable to that of other educational institutions of like enrollment and standing, to be paid out of the school budget. (Section 10)
- The Board of Trustees shall have the following powers and duties: (Section 11)
    a. To appropriate funds for the support of the College. (Section 11a)
    b. To confer degrees upon successful candidates for graduation, and honorary degrees upon persons in recognition of learning, statesmanship, eminence in the College's fields of specialization, or public service, subject to approval of the Secretary of Education and Culture. (Section 11b)
    c. To authorize the President to award proficiency certificates or diplomas to students who have completed non-degree courses. (Section 11c)
    d. To appoint, fix compensation, and grant leave of absence to the Vice-President, deans, directors, secretaries, registrar, heads of departments, professors, instructors, lecturers, and other officials and employees of the College, upon recommendation of the President. To remove them for cause after an investigation and hearing. To establish and maintain chairs in the College. (Section 11d)
    e. To approve the curricula and rules of discipline drawn by the College Council. (Section 11e)
    f. To fix tuition fees, matriculation fees, graduation fees, and such special fees as will constitute a special trust fund for the College. (Section 11f)
    g. To provide fellowships for qualified faculty members and scholarships to deserving students. (Section 11g)
    h. To prescribe rules and regulations for the College, not contrary to law, as may be necessary to carry out its purpose and function. (Section 11h)
    i. To receive in trust legacies, gifts, and donations of real and personal property for the benefit of the College or its students, in accordance with the donor's directions, or in the Board's discretion. Such donations shall be exempt from all taxes and deductible from the income tax of the donors. (Section 11i)
    j. To authorize the College to undertake construction and/or repair of its buildings, machinery, equipment, and other facilities, subject to existing laws, orders, and decrees. (Section 11j)
- The Board of Trustees shall file a detailed report with the Office of the Secretary of Education and Culture on or before the fifteenth day of the second month after the opening of regular classes each year, setting forth the progress, conditions, and needs of the College. (Section 12)
- There shall be a College Council consisting of the President and all faculty members with the rank of professors. The Council shall have the power to prescribe the curricula and rules of discipline, subject to approval of the Board of Trustees. It shall fix the requirements for admission, graduation, and conferring of degrees, subject to review by the Board. The Council shall have disciplinary power over the students within the limits prescribed by the rules of discipline, through the President or its authorized committee. (Section 13)
- The body of instructors and professors of the College shall constitute the faculty of the College. (Section 14)
- No member of the faculty shall attempt to influence students or any person in the College towards any ideology, political or otherwise, which preaches the overthrow of the government through violence or subversion, under penalty of dismissal by the Board of Trustees. (Section 15)
- There shall be a Secretary of the College appointed by the Board of Trustees, who shall also act as the Secretary of the Board and keep such records of the College as may be designated by the Board. (Section 16)
- Heads of bureaus or offices of the National Government are authorized to loan or transfer apparatus or supplies needed by the College, upon request of the President, when such supplies or apparatus can be spared without detriment to the public service. The Commanding General of PAF and Director of Civil Aeronautics Administration may allow their employees to serve with the College, subject to existing laws, rules, and regulations. (Section 17)
- The College shall be self-supporting and non-profit, and shall aspire to give low-cost education and training without sacrificing standards comparable to other technical institutions. The income derived from fees shall be used to defray the cost of operations, and any balance shall be used to improve facilities and broaden curricular offerings. (Section 18)
- This Decree shall take effect upon its approval. (Section 19)
