• Section 1: The Iligan City National School of Fisheries (ICNSF) in Barangay Buru-un, Iligan City, Province of Lanao del Norte, is converted into a polytechnic state college, to be known as the Iligan City Polytechnic State College (ICPSC), with its main campus in Iligan City.
General Mandate
• Section 2: The ICPSC shall primarily provide advanced instruction and professional training in education, engineering, science and technology, arts and humanities, information and communications technology, agriculture, forestry, and other relevant fields of study. It shall also undertake research and extension services and production activities in support of the socioeconomic development of the Province of Lanao del Norte and Region X.
Curricular Offerings
• Section 3: The ICPSC shall offer short-term technical-vocational, undergraduate, and graduate courses in education, engineering, science and technology, arts and humanities, information and communications technology, agriculture, forestry, fishery education, marine transportation, tourism, and other relevant fields. • It shall also offer vocational and technology courses in welding technology, vocational technology, hotel and restaurant services, hotel and household services, baking technology, electronic services and repair, and other relevant fields. • The existing and future technical-vocational courses under the supervision of the Technical Education and Skills Development Authority (TESDA) shall continue to be offered. • The existing reasonably-sized laboratory junior and senior high school and elementary school shall continue to operate under the supervision of the College of Education.
Administration
• Section 4: The ICPSC shall have the general powers of a corporation set forth in the Corporation Code of the Philippines. The exercise of its corporate powers shall be vested exclusively in the Board of Trustees and the President of the College.
The Governing Board
• Section 5: The governing body of the ICPSC shall be the Board of Trustees, chaired by the Chairperson of the Commission on Higher Education (CHED) and co-chaired by the President of the College. • The Board shall consist of representatives from the Senate, House of Representatives, National Economic and Development Authority, Department of Science and Technology, Department of Agriculture, TESDA, faculty associations, student councils, alumni associations, and two prominent citizens from the private sector. • The Board shall appoint two prominent citizens from a list of at least five qualified persons from the Province of Lanao del Norte, as recommended by a search committee. They shall serve for a term of two years.
Powers and Duties of the Board of Trustees
• Section 6: The Board shall have various powers and duties, including:
- Promulgating and implementing policies in accordance with state policies on education, agriculture, science and technology, and the policies of CHED and TESDA (6a).
- Approving curricula, instructional programs, and rules on student discipline (6b).
- Appointing vice presidents, deans, directors, faculty members, and other officials and employees (6c).
- Fixing and adjusting salaries, granting leaves of absence, and removing employees for cause (6d).
- Fixing tuition fees and other necessary school charges, and retaining and disbursing income generated by the College (6e).
- Adopting and implementing a socialized scheme of tuition and other school fees for greater access of poor but deserving students (6f).
- Establishing professorial chairs, fellowships, and scholarships (6g).
- Receiving and appropriating funds for the support of the College (6h).
- Setting policies on admission and graduation of students (6i).
- Awarding honorary degrees and authorizing the awarding of certificates of completion of non-degree and non-traditional courses (6j).
- Establishing research and extension centers (6k).
- Developing academic arrangements for institutional capability building with appropriate institutions and agencies (6l).
- Adopting modern and innovative modes of transmitting knowledge (6m).
- Collaborating with other colleges in restructuring the College (6n).
- Absorbing non-chartered tertiary institutions as branches and extension/external centers (6o).
- Authorizing an external management audit of the College (6p).
- Developing consortia and other economic forms of linkages with local government units and other institutions (6q).
- Importing economic, technical and cultural books and publications (6r).
- Entering into joint ventures with business and industry (6s).
- Receiving legacies, gifts and donations (6t).
- Extending the term of the President beyond the age of retirement, but not beyond the age of seventy, based on outstanding performance and unanimous recommendation (6u).
- Delegating powers and duties to the President and other officials (6v).
- Establishing policy guidelines and procedures for participative and transparent decision-making (6w).
- Privatizing the management of non-academic services (6x).
- Authorizing the construction or repair of buildings, machinery, equipment, and facilities, and the purchase and acquisition of real property (6y).
- Promulgating rules and regulations to carry out the purposes and functions of the College (6z).
Meetings of the Board
• Section 7: The Board shall regularly convene once every three months. A quorum shall consist of a majority of all its members, with the Chairperson of the Board or the President of the College present. Members shall not receive any salary but shall be entitled to reimbursements for actual and necessary expenses.
The College President
• Section 8: The ICPSC shall be headed by a President appointed by the Board, subject to its guidelines on qualifications and standards, and based on the recommendation of a search committee. • The President shall render full-time service and shall have a term of four years, but may be reappointed to another term. • The incumbent President of the ICNSF, if qualified, shall serve as the first President of the ICPSC. • The President shall be assisted by a Vice President for Academic Affairs, a Vice President for Administration, and a Vice President for Research, Development and Extension.
The Secretary and Treasurer of the College
• Section 9: The Board shall appoint a Secretary who shall serve as such for both the Board and the College.
• Section 10: The Treasurer of the Philippines shall be the ex officio Treasurer of the College.
The Administrative Council and Academic Council
• Section 11: There shall be an Administrative Council consisting of the President, vice presidents, deans, directors and other officials, that shall review and recommend policies on administration, management and development planning.
• Section 12: There shall be an Academic Council composed of the President and all academic staff with the rank of at least an assistant professor, that shall formulate academic policies, review and recommend curricular offerings and rules on student discipline, fix requirements for admission and graduation, and exercise disciplinary power over students.
The Faculty
• Section 13: No political belief, gender preference, cultural or community affiliation, ethnic origin, or religious opinion or affiliation shall be a matter of inquiry in the appointment of faculty members, subject to the guidelines, qualifications, and standards set by the Board. No faculty member shall teach for or against any particular church or religious sect.
Academic Freedom and Institutional Autonomy
• Section 14: The ICPSC shall enjoy academic freedom and institutional autonomy pursuant to the Constitution.
Scholarship Programs and Admission
• Section 15: The ICPSC shall provide scholarship and other affirmative action programs to assist poor but deserving students. No student shall be denied admission by reason of gender, religion, cultural or community affiliation, physical disability or ethnic origin.
Authority to Loan or Transfer Apparatus, Equipment, Supplies and Detail of Personnel
• Section 16: The heads of the bureaus and offices of the national government are authorized to loan or transfer apparatus, equipment or supplies, and detail employees for duty in the College, when such can be spared without serious detriment to public service.
Assets, Liabilities and Personnel
• Section 17: All assets, real and personal, personnel, records, liabilities and obligations of the ICNSF are transferred to the ICPSC. The positions, rights and security of tenure of faculty members and personnel shall be respected. All parcels of land belonging to the government occupied by the ICNSF are declared property of the ICPSC.
Tax Exemption on Importation and Donations
• Section 18: The importation by the ICPSC of economic, technical and cultural books or publications for economic, technical, vocational, scientific, philosophical, historical or cultural purposes shall be exempt from customs duties upon certification by the CHED. All grants, bequests, endowments, donations and contributions made to and used by the ICPSC shall be exempt from donor's tax and considered as allowable deduction from the gross income of the donor.
Compliance with CHED Requirements
• Section 19: The conversion of the ICNSF to a college shall become effective upon the determination and declaration by the CHED that the institution has complied with the requirements for college status, including employment of full-time, permanent faculty members with relevant degrees, offering of a comprehensive range of degree programs, establishment and maintenance of comprehensive learning resources and support structures, maintenance of linkage with the community, and conduct of outreach programs involving students.
Development Plan, Management Audit, and Organizational/Administrative/Academic Structure
• Section 20: Within 120 days after the approval of this Act, the ICPSC shall:
- Submit a five-year development plan, including its program budget to the CHED for recommendation to the DBM.
- Set up its organizational, administrative, and academic structure, including the appointment of key officials.
- Undergo a management audit in coordination with the CHED.
Filing of Report
• Section 21: On or before the fifteenth day of the second month after the opening of regular classes each year, the Board shall file with the Office of the President of the Philippines, through the CHED Chairperson, and with both Houses of Congress, a detailed report on the progress, condition, and needs of the College.
Suppletory Application
• Section 22: The provisions of the Higher Education Modernization Act of 1997 shall form part of this Act and serve as part of the governing charter of the College.
Parity Clause
• Section 23: All other powers, functions, privileges, responsibilities, and limitations under existing laws shall be deemed granted to or imposed upon the College and its officials, whenever appropriate.
Appropriations
• Section 24: The amount necessary to carry out the provisions of this Act shall be included in the annual General Appropriations Act.
Implementing Rules and Regulations
• Section 25: Within sixty days from the effectivity of this Act, the Board, in consultation with the CHED, shall formulate the rules and regulations to fully implement the provisions of this Act.
Separability Clause
• Section 26: If any part or provision of this Act is declared invalid or unconstitutional, the remaining parts or provisions not affected shall remain in full force and effect.
Repealing Clause
• Section 27: All laws, presidential decrees, executive orders, and rules and regulations contrary to or inconsistent with the provisions of this Act are repealed or modified accordingly.
Effectivity
• Section 28: This Act shall take effect fifteen days after its publication in the Official Gazette or in a newspaper of general circulation.

SECTION 1.
