AN ACT CONVERTING THE ILOCOS SUR POLYTECHNIC STATE COLLEGE IN THE MUNICIPALITY OF STA. MARIA, PROVINCE OF ILOCOS SUR, AND ALL ITS CAMPUSES IN THE PROVINCE OF ILOCOS SUR, INTO A STATE UNIVERSITY, INTEGRATING THEREWITH THE NORTH LUZON PHILIPPINES STATE COLLEGE IN THE CITY OF CANDON, PROVINCE OF ILOCOS SUR, TO BE KNOWN AS THE UNIVERSITY OF ILOCOS PHILIPPINES, AND APPROPRIATING FUNDS THEREFOR
SECTION 1.Conversion/Integration. — The Ilocos Sur Polytechnic State College (ISPSC) located in the Municipality of Sta. Maria, with campuses in the municipalities of Narvacan, Tagudin, Santiago, Cervantes, and in the City of Candon, all in the Province of Ilocos Sur, as well as other campuses that will be created prior to the effectivity of this Act, is hereby converted into a state university, and integrating therewith the North Luzon Philippines State College (NLPSC) located in the City of Candon, Province of Ilocos Sur, to be known as the University of Ilocos Philippines (UIP). Conversion/Integration (Section 1):
- The Ilocos Sur Polytechnic State College (ISPSC) and its campuses in Ilocos Sur, as well as the North Luzon Philippines State College (NLPSC) in Candon City, are converted and integrated into the University of Ilocos Philippines (UIP).
- The main campus of UIP shall be located in Candon City.
- Upon effectivity, NLPSC shall be integrated into ISPSC as a regular campus called ISPSC-Main Campus.
General Mandate (Section 2):
- UIP shall provide advanced education, higher professional and technological instruction, technical and vocational education and training in various fields.
- It shall undertake research, extension services, and production activities to support socioeconomic development in Ilocos Sur and Region I.
Curricular Offerings (Section 3):
- UIP shall offer short-term technical-vocational, undergraduate, graduate, and post-graduate programs in fields like agriculture, education, business, arts, technology, engineering, architecture, health sciences, criminal justice, and others.
- It shall continue operating a reasonably-sized laboratory junior high school under the College of Education.
- Existing and future technical-vocational courses under TESDA shall continue to be offered.
Administration (Section 4):
- UIP shall have general corporate powers set forth in the Revised Corporation Code.
- Its corporate powers shall be vested in the Board of Regents and the President.
Governing Board (Section 5):
- The Board of Regents shall be chaired by the CHED Chairperson and co-chaired by the UIP President, with members from various government agencies, faculty, students, alumni, and private sector.
- Two prominent private sector citizens shall be appointed by the Board for a 2-year term.
Powers and Duties of the Board (Section 6):
- The Board shall have powers and duties related to policy formulation, curriculum approval, appointment of officials, salary and leave regulation, fee fixing, scholarship programs, infrastructure development, consortium arrangements, and other administrative matters.
Meetings of the Board (Section 7):
- The Board shall meet quarterly, with provisions for special meetings and quorum requirements.
- Members shall be entitled to reimbursements for expenses related to Board meetings.
The University President (Section 8):
- UIP shall be headed by a President appointed by the Board for a 4-year term, renewable once.
- The incumbent ISPSC President shall serve as the first UIP President if qualified.
- The President's powers, duties, and salary shall be in accordance with relevant laws.
Other Officials (Sections 9-13):
- The Board shall appoint a Secretary to keep records and serve notices.
- The Treasurer of the Philippines shall be the ex officio Treasurer of UIP.
- There shall be an Administrative Council and an Academic Council to review policies.
- Campus Directors shall head the respective campuses and be appointed by the Board.
Faculty and Academic Freedom (Sections 14-16):
- Faculty appointments shall not discriminate based on beliefs, gender, culture, or religion.
- UIP shall enjoy academic freedom and institutional autonomy.
- UIP shall provide scholarships and admission shall not discriminate against any student.
Authority to Loan Resources (Section 17):
- Government offices may loan apparatus, equipment, supplies, and detail personnel to UIP as needed.
Assets, Liabilities, and Personnel (Section 18):
- All assets, liabilities, personnel, and records of ISPSC and NLPSC shall be transferred to UIP.
- Positions, rights, and tenure of existing personnel shall be respected.
- Government lands occupied by ISPSC and NLPSC shall be titled under UIP's name.
Tax Exemptions (Section 19):
- Importation of books and publications for educational purposes shall be exempt from customs duties.
- Donations to UIP for educational purposes shall be exempt from donor's tax and deductible from the donor's taxable income.
Research Centers (Section 20):
- Seven research centers shall be established, focusing on fisheries, forestry, rural health, animal research, tobacco and agriculture, indigenous peoples education, and public administration and governance.
Compliance with CHED Requirements (Section 21):
- Conversion to a university shall be effective upon CHED's determination of compliance with requirements like faculty qualifications, degree programs, research activities, learning resources, and global linkages.
Development Plan and Management Audit (Section 22):
- Within 120 days, UIP shall submit a 5-year development plan, set up its organizational structure, and undergo a management audit.
Reporting (Section 23):
- The Board shall file an annual report on UIP's progress, conditions, and needs with the President and Congress.
Other Provisions (Sections 24-30):
- The Higher Education Modernization Act shall apply to UIP.
- UIP shall have parity with other institutions in terms of powers, functions, and privileges.
- Appropriations shall be charged against current appropriations of ISPSC and NLPSC, and thereafter included in the annual General Appropriations Act.
- Implementing rules shall be formulated within 60 days.
- The Act has separability and repealing clauses, and shall take effect 15 days after publication in the Official Gazette or a newspaper.
