PRESIDENTIAL DECREE No. 1427

CONVERTING THE ZAMBOANGA STATE COLLEGE INTO THE WESTERN MINDANAO STATE UNIVERSITY, DEFINING ITS POWERS, FUNCTIONS, AND DUTIES AND APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES

WHEREAS, the Constitution of the Philippines directs the State to establish and maintain a complete, adequate, and integrated system of education relevant to the goals of national development and prescribes that all educational institutions shall aim to develop scientific, technological and vocational efficiency;

WHEREAS, under Presidential Decree No. 6-A otherwise known as the Educational Development Decree of 1972, promulgated on September 29, 1972, it had been declared a policy of the government to reorient the educational system toward an accelerated national economic growth and meaningful social development;

WHEREAS, the Western Mindanao Region, comprising the provinces of Sulu, Tawi-Tawi, Basilan Province, Zamboanga del Norte, and Zamboanga del Sur and the cities of Dapitan, Dipolog, and Pagadian and Zamboanga, is endowed with natural resources the exploitation, utilization, and conservation of which will certainly accelerate its development, thereby contributing immensely...

Summary of Presidential Decree No. 1427

Conversion and Establishment
- The Zamboanga State College is converted into the Western Mindanao State University (WMSU) to serve the Western Mindanao region. (Section 1)

Composition of the University
- The University shall be composed of the existing academic departments, institutes, administrative units, and external units of the Zamboanga State College, reorganized as follows:
    - Graduate Department becomes Graduate School
    - Institute of Arts and Sciences becomes College of Arts and Sciences, College of Forestry, and College of Social Work
    - Institute of Education becomes College of Education
    - Institute of Nursing becomes College of Nursing
    - Institute of Engineering becomes College of Engineering and Technology
    - External studies at Dipolog City, Tawi-Tawi, and Sulu become External Units at Zamboanga del Norte, Tawi-Tawi, and Sulu respectively
- A College of Agriculture, College of Medicine, External Units at Zamboanga del Sur and Basilan Province, and other new colleges or units may be organized later. (Section 2)

Purpose
- The main purpose of the University is to provide leadership in professional and technical instruction in arts, sciences, and technology for national and regional development.
- It shall offer undergraduate and graduate courses in arts and sciences, education, medical sciences, agriculture and forestry, engineering and technology, and other necessary courses.
- It shall promote research in various disciplines for the advancement of knowledge and socio-economic and cultural development of the region. (Section 3)

Powers of the University
- The University shall have the general powers set forth in Section 13 of Act No. 1459, as amended, vested in the Board of Regents and the President.
- It shall have the power to acquire public lands and real estate for expansion and beneficial use, and to purchase necessary vehicles, conveyances, facilities, and equipment. (Section 4)

The Governing Board
- The government of WMSU is vested in a Board of Regents composed of 7 members:
    - 3 regular members (1 President of Alumni Association, 2 from private sector appointed by the President of the Philippines)
    - 4 ex-officio members (Secretary of Education and Culture as Chairman, Regional Commissioner for Region IX, Executive Director of NEDA for Region IX, President of the University)
- Regular members serve for 4 years and receive a per diem of ₱100 per meeting, up to ₱200 per month.
- The Board has various powers and duties related to administration, appointment of the University President, establishment of colleges, receiving donations, appointing personnel, approving courses and fees, providing fellowships and scholarships, conferring honorary degrees, and reporting to the President of the Philippines. (Section 5)

Administration
- The administration is vested in the full-time President of the University, appointed by the President of the Philippines.
- The President is assisted by a Vice President for Academic Affairs and a Vice President for Administrative Affairs, appointed by the Board of Regents. (Section 6)

Powers of the President
- The President has powers to recommend appointments of personnel, promulgate regulations, and call for special meetings of the Board of Regents. (Section 7)

The Secretary of the University
- The Board of Regents shall appoint a Secretary who shall serve as the Secretary for both the Board and the University. (Section 8)

The University Council
- There shall be a University Council consisting of the President and faculty members holding ranks of professor, associate professor, and assistant professor.
- The Council has the power to prescribe courses of study and rules of discipline, subject to approval by the Board of Regents.
- It shall fix requirements for admission, graduation, and conferment of degrees.
- It has disciplinary power over students within the limits prescribed by the Board of Regents. (Section 9)

The University Planning Center
- There shall be a Planning Center composed of a director and committees on curriculum, studentry, staff development, university plant, and external affairs.
- The Center shall assist the President in planning for expansion, growth, development, and proper management and operation of the University. (Section 10)

The University Research Center
- There shall be a Research Center to coordinate research activities of academic units and faculty, and plan research programs.
- It shall be headed by a Dean appointed by the Board of Regents, and have a Research Council chaired by the Vice President for Academic Affairs. (Section 11)

Officers of Administration
- The Officers of Administration include the President, Vice Presidents, Deans of colleges, Secretary, Director of Administrative Affairs, Deans of Research Center, Extension Services, External Studies, Admissions, and Student Affairs. (Section 12)

Faculty and Other Personnel
- The body of professors and instructors of each college shall constitute its faculty, presided over by a Dean.
- No religious tests shall be required for appointment, and no sectarian tenets shall be inculcated.
- The faculty and personnel of Zamboanga State College shall be absorbed without reduction in position, rank, or salary. (Section 13)

Civil Service Requirements
- The President, professors, and instructors are exempt from civil service examinations or regulations for appointment.
- They are entitled to privileges and rights of security of tenure, promotion, salaries, sabbatical leave, leaves, and retirement benefits as provided by law. (Section 14)

The Auditor of the University
- The Auditor General of the Philippines shall be the ex-officio Auditor of the University and shall designate a representative to perform duties efficiently. (Section 15)

The Board of Visitors of the University
- The President of the Philippines, First Lady, Secretary of Education and Culture, and Regional Commissioner for Western Mindanao shall constitute a Board of Visitors.
- Their duty is to attend commencement exercises, make visits, examine property and finances, inspect books of accounts, and report and make recommendations to the President of the Philippines. (Section 16)

Appropriations
- The appropriation of Zamboanga State College shall be transferred to WMSU.
- Funds for maintenance shall be included in the Annual Budget of the National Government, as recommended by the Board of Regents.
- Public works appropriations earmarked for Zamboanga State College are transferred to WMSU and shall continuously be allotted. (Section 17)

Property of the University
- The assets, fixed and movable, and records of Zamboanga State College are transferred to WMSU.
- An area of 20 or more hectares in San Ramon, Zamboanga City, administered by the Philippine Coconut Authority, is transferred to WMSU for the College of Agriculture. (Section 18)

General Provisions
- The Secretary of Education and Culture is directed to take steps for immediate implementation.
- All inconsistent laws, decrees, orders, rules, and regulations are repealed, modified, or amended accordingly. (Section 19)

Effectivity
- This Decree shall take effect immediately. (Section 20)
