EXECUTIVE ORDER No. 463

CREATING A NATIONAL ANTI-CRIME TASK FORCE UNDER THE PRESIDENTIAL ANTI-ORGANIZED CRIME COMMISSION (PAOCC), AMENDING SECTION 2 OF EXECUTIVE ORDER NO. 295 (S. 2000) AND FOR OTHER PURPOSES

WHEREAS, Article II, Section 5 of the Constitution provides that the maintenance of peace and order, the protection of life, liberty, and property, and the promotion of the general welfare are essential for the enjoyment by all people of the blessings of democracy.

WHEREAS, Executive Order No. 295 (s. 2000) created the Presidential Anti-Organized Crime Commission (PAOCC) to bring about focus and substantive results in the campaign against criminality;

WHEREAS, enhanced coordination between and among agencies engaged in the fight against criminality will lead to improved effectiveness and efficiency in the government’s efforts to maintain peace and order;

WHEREAS, numerous task forces have been created to deal with specific crimes and there is a need to streamline these task forces to rationalize resources and harmonize strategies that will intensify the fight against criminality;

Summary of Executive Order No. 463

Creation of National Anti-Crime Task Force (NACTAF)
- NACTAF is created under the Presidential Anti-Organized Crime Commission (PAOCC). (Section 1)
- Headed by the Secretary of the Interior and Local Government as NACTAF Head, with a Deputy Head and Executive Director. (Section 1)
- Staffed by a composite team from law enforcement and related agencies. (Section 1)

Amendment to Executive Order No. 295
- Secretary of the Interior and Local Government designated as Vice-Chairman of PAOCC. (Section 2)
- National Security Adviser remains a member of PAOCC. (Section 2)

Powers and Functions of NACTAF
- Direct operations and cause immediate arrest and investigation of crime suspects. (Section 3a)
- Conduct intelligence and counter-intelligence operations to identify crime suspects. (Section 3b)
- Refer cases to Department of Justice and other investigative bodies. (Section 3c)
- Monitor and follow-up ongoing investigations and prosecutions. (Section 3d)
- Refer cases involving alleged proceeds and gains of crime for forfeiture and seizure proceedings. (Section 3e)
- Select personnel for detail to NACTAF in coordination with other agencies. (Section 3f)
- Call upon government agencies and local government units for anti-crime efforts. (Section 3g)
- Grant monetary rewards or incentives to informants, subject to existing laws. (Section 3h)
- Coordinate with Witness Protection Program for witness protection, subject to existing laws. (Section 3i)
- Develop public awareness and information campaigns with local government units and civic organizations. (Section 3j)
- Recommend policies and legislation to hasten arrest and prosecution of criminals. (Section 3k)
- Undertake research and maintain a database on heinous crimes, offenders, modus operandi, victims, etc. (Section 3l)
- Establish mechanisms for cooperation and joint operations with international law enforcement agencies. (Section 3m)
- Perform other functions assigned by the President. (Section 3n)

Offenses Covered
- NACTAF has authority to take cognizance of heinous crimes defined under Republic Act No. 7659 (Heinous Crime Law) and other related laws. (Section 4)
- NACTAF may also take cognizance of other crimes as directed by the President. (Section 4)

Streamlining of Anti-Crime Bodies
- NACTAF shall assess anti-crime bodies created by executive issuances and recommend their retention, abolition or reconstitution under NACTAF. (Section 5)

Coordinating Instructions
- NACTAF shall not derogate the Philippine National Police's role as primary general law enforcement agency. (Section 6)
- Close coordination and cooperation between NACTAF Head, PNP Chief and other law enforcement agency heads to ensure synergy in anti-crime campaign. (Section 6)

Reports
- NACTAF shall submit quarterly reports to the President and PAOCC on its activities with recommendations. (Section 7)

Funding
- NACTAF's operational budget sourced from PAOCC budget and other available funds. (Section 8)
- NACTAF's budget to be incorporated in PAOCC's budget proposal under the Office of the President. (Section 8)

Operating Guidelines
- NACTAF shall adopt necessary operating guidelines to implement the Executive Order. (Section 9)

Repealing Clause
- All rules, regulations and issuances inconsistent with this Executive Order are repealed or modified accordingly. (Section 10)

Effectivity
- This Executive Order takes effect immediately. (Section 11)
