CREATING A PRESIDENTIAL TASK FORCE OF INTELLIGENCE AND COUNTER-INTELLIGENCE TO IDENTIFY, ARREST AND CAUSE THE INVESTIGATION AND PROSECUTION OF MILITARY AND OTHER LAW ENFORCEMENT PERSONNEL ON THEIR FORMER MEMBERS AND THEIR COHORTS INVOLVED IN CRIMINAL ACTIVITIES
WHEREAS, the crime situation in the country continues to defy meaningful solution even as it tends to undermine the gains the government has made in its economic recovery effort;
WHEREAS, the public views eight deep concern the alarming increase in heinous crimes, particularly kidnap for ransom bank robbery, and other organized crimes';
WHEREAS, current statistics from the Presidential Anti-Crime commission show that 40% of organized crimes Commission show involve scalawags in the military and law enforcement agencies, either active, discharge from the service or absent without leave.
WHEREAS, the government drive against criminality will encounter difficulty unless these scalawags and their cohorts are identified, arrested, prosecuted ad put in jail;

Creation of Presidential Task Force on Intelligence and Counter-intelligence Against Scalawags (Section 1)
- Organized to identify, arrest, investigate, and prosecute military and law enforcement personnel involved in criminal activities.
Leadership, Composition, and Organizational Structure (Section 2)
- Headed by the Chief of Intelligence Service, Armed Forces of the Philippines (AFP).
- Deputy Task Force Commanders from Philippine National Police (PNP) and National Bureau of Investigation (NBI).
- Functional staff to assist the Task Force Commander.
- Task Force Operations Center (TFOC) to monitor day-to-day operations.
- Component forces from PNP, NBI, Department of Justice (DOJ), National Intelligence Coordinating Agency (NICA), AFP, and other agencies.
- Regional Task Groups to be created, prioritizing certain regions.
Coordination and Enlistment of Assistance (Section 3)
- Authorized to enlist assistance from any government branch, department, bureau, office, agency, or instrumentality.
Command and Control (Section 4)
- Task Force Commander reports directly to the President.
- Commander has direct responsibility, supervision, and control over all component forces.
- Component forces assigned and attached to the Task Force, reporting to the Task Force Headquarters daily.
- Component force commanders report directly to the Task Force Commander.
Powers and Functions (Section 5)
- Conduct intelligence and counter-intelligence operations to detect and identify active and former military and police personnel involved in criminal activities. (Section 5a)
- Cause or direct the immediate arrest, investigation, and speedy prosecution of such personnel and their cohorts. (Section 5b)
- Refer cases to the Presidential Anti-Crime Commission (PACC) or other law enforcement agencies for investigation or prosecution. (Section 5c)
- Monitor the progress of ongoing investigations and prosecutions. (Section 5d)
- Recommend appropriate anti-crime issuances and legislation. (Section 5e)
- Conduct other special anti-crime operations as directed by the President. (Section 5f)
Duties and Tasks (Section 6)
- Task Force Commander: Responsible for successful implementation of mission and functions. (Section 6a)
- Deputy Task Force Commanders: Advise on intelligence/operations and legal/investigation matters. (Sections 6b, 6c)
- Executive Officer: Principal staff adviser, supervises implementation of policies and instructions. (Section 6d)
- Working Staff: Advise on various matters, including personnel, supply, logistics, technical support, intelligence/operations, and legal/investigation. (Section 6e)
- Task Force Operations Center (TFOC): Monitors day-to-day operational activities. (Section 6f)
- DOJ Component: Responsible for prosecution of cases and securing warrants. (Section 6g)
- NICA/PNP/NBI/AFP Components: Conduct case buildup, counteraction operations, gather evidence against targeted suspects. (Section 6h)
- Regional Task Groups (RTGs): Conduct case buildup, counteraction operations, and prosecution in their respective areas of responsibility. (Section 6i)
Operating Guidelines (Section 7)
- Focus efforts primarily against scalawags in the AFP and other law enforcement agencies, or their former members, involved in criminal activities. (Section 7a)
- Prioritize the destruction of organized big-time criminal groups/syndicates involving military, police, and former military or police personnel. (Section 7b)
- Priority criminal activities: kidnapping for ransom, bank robberies, drug trafficking, gunrunning, and carnapping. (Section 7b)
- All operations require prior clearance and knowledge of the Task Force Commander. (Section 7c)
- Component forces may operate independently or jointly, depending on the nature of the target and operational necessity. (Section 7d)
- Respective component forces will be given the first opportunity to conduct investigation/case buildup of identified scalawags in their units/agencies. (Section 7e)
- Counteraction operations aim to bring suspects to justice for successful prosecution. (Section 7f)
Funding (Section 8)
- Initial allocation of Twenty Million Pesos (P20,000,000) from the Office of the President's contingency fund and/or government savings for CY 1995.
- Subsequent funding to be drawn from the Contingency Fund for CY 1996 and included in the annual government budget thereafter.
Effectivity (Section 9)
- This Executive Order takes effect immediately.
