PRESIDENTIAL DECREE No. 1325

CREATING BARANGAY MERVILLE IN THE MUNICIPALITY OF PARAÑAQUE, METRO MANILA

WHEREAS, the fundamental aim of the State is to hasten up the pace of socio-economic development throughout the country;

WHEREAS, the effective implementation of the declared programs of the government on development hinges primarily on the administrative efficiency of each and every local government units;

WHEREAS, it has been the clamor of the residents of the proposed barangay with the conformity of the elective officials of the locality to create the new barangay so as to achieve a closer supervision of the execution of the developmental programs of the locality;

WHEREAS, the creation of the proposed barangay will redound and contribute greatly to the upliftment of the socio-economic well-being of the residents therein;

Summary of Presidential Decree No. 1325

Creation of Barangay Merville
- The subdivisions of Admiral Village and Merville in Barangay La Huerta, Parañaque, Metro Manila are detached and separated to form a new and independent barangay called Barangay Merville. (Section 1)
- The creation of Barangay Merville does not affect the legal existence of the mother barangay, Barangay La Huerta.

Applicability of Laws
- Except as provided in the decree, all laws applicable to regular barangays shall also apply to Barangay Merville. (Section 2)

Barangay Officials
- The current elective barangay officials of Barangay La Huerta shall continue to perform their duties in the newly created Barangay Merville until new officials are appointed by the President. (Section 3)
- The appointed officials shall hold office until their successors are elected in the regular elections for barangay officials following the issuance of the decree, unless removed earlier by the President.
- Necessary appointive officers and employees shall be appointed to organize or complete the government personnel of Barangay Merville as provided for under existing laws.

Transfer of Assets and Liabilities
- Upon the effectivity of the decree, the proportionate share of Barangay Merville in the obligations, funds, assets, and other property of Barangay La Huerta shall be transferred by the President to the newly created barangay upon the recommendation of the Commission on Audit. (Section 4)

Repealing Clause
- All laws, executive orders, or regulations inconsistent with the decree are hereby repealed or modified accordingly. (Section 5)

Effectivity
- The decree shall take effect immediately. (Section 6)
