EXECUTIVE ORDER NO. 184

Summary:

- Creates Socialized Housing One-Stop Processing Centers (SHOPCs) in all administrative regions to facilitate processing and issuance of permits, clearances, certifications, and licenses for socialized housing projects. (Section 1)

- SHOPCs to be manned by representatives from:
• Housing and Urban Development Coordinating Council (HUDCC)
• Housing and Land Use Regulatory Board (HLURB)
• Department of Agrarian Reform (DAR)
• Department of Environment and Natural Resources-Land Management Bureau (DENR-LMB)
• Department of Agriculture (DA)
• Department of the Interior and Local Government (DILG) (Section 1)

- SHOPCs have the power to:
• Issue Locational Clearances, Conversion Orders or Certificates of Exemption, Development Permits, and Licenses to Sell for socialized housing projects. (Section 2a)
• Issue Environmental Clearance Certificates when required. (Section 2b)
• Determine and ensure payment of disturbance compensation for affected tenant-farmers/farmworkers. (Section 2c)
• Simplify processing and approval of licenses, permits, and clearances within 90 days as mandated by Republic Act No. 7279. (Section 2d)
• Call on other agencies for support as necessary. (Section 2e)

- Responsibilities of SHOPC Desks are outlined in detail. (Section 3)

- Agencies to jointly promulgate processing guidelines and flow chart to expedite approval within 90 days as per Republic Act No. 7279. (Section 4)

- Concerned agencies to submit certain documents and maps to SHOPCs within 30 days for successful operation. (Section 5)

- Developer/proponent to file sworn Undertaking stating project completion timeline of 1 year for <5 hectares, and 5 hectares/year for ≥5 hectares. (Section 6a)
• Penalties for non-compliance include cancellation/suspension of permits, suspension from real estate development, and land reversion. (Section 6b)

- SHOPCs authorized to impose additional fees and charges as determined by HUDCC. (Section 7)

- Component agencies to include pro-rata share of SHOPC administrative and operational costs in their annual budgets. (Section 8)

EXECUTIVE ORDER NO. 184 June 27, 1994 CREATING SOCIALIZED HOUSING ONE-STOP PROCESSING CENTERS TO FACILITATE THE PROCESSING AND ISSUANCE OF PERMITS, CLEARANCES, CERTIFICATIONS AND LICENSES APPROPRIATE AND NECESSARY FOR THE IMPLEMENTATION OF SOCIALIZED HOUSING PROJECTS, AND DIRECTING ALL GOVERNMENT AGENCIES CONCERNED TO SUPPORT THE OPERATIONS OF THE SAID CENTERS WHEREAS, consistent with Section 9, Article III of the Constitution which mandates the provision of decent housing and basic services to the underprivileged and homeless, the present Administration through the various housing agencies of the government, has embarked on a massive socialized housing program; WHEREAS, to attain targets set under the government's socialized housing program, maximum private sector participation is imperative: WHEREAS, in undertaking socialized housing projects contemplated under Republic Act No. 7279 otherwise known as the Urban Development and Housing Act of 1992, the developer/proponent must secure the appropriate and necessary permits, clearances, certifications and licenses from various government agencies which include the Department of Agrarian Reform (DAR), the Department of Environment and Natural Resources (DENR), the Department of Agriculture (DA), the Housing and Land...
