CREATION OF THE CEMENT INDUSTRY AUTHORITY- The Cement Industry Authority is created to regulate the cement industry and expand cement exports. (Section 1)
COMPOSITION AND DURATION
- The Authority is composed of the Chairman of the Board of Investments (as Chairman), and heads of the Central Bank, Departments of Finance and Trade, and Development Bank (as members). (Section 1)
- The Authority shall exist for 3 years from the date of the decree. (Section 2)
EXPORT FUNCTIONS
- The Authority shall handle all cement and clinker exports from the Philippines. (Section 3)
- Its export functions include:
- Embarking on an aggressive export campaign. (Section 3.1)
- Negotiating and entering into export contracts, considering industry costs. (Section 3.2)
- Negotiating shipping contracts, including vessel purchase/charter. (Section 3.3)
- Establishing foreign storage facilities for Philippine cement. (Section 3.4)
- Negotiating agreements with other cement exporters to prevent competition. (Section 3.5)
- Arranging financing for export commitments. (Section 3.6)
- Assigning export contracts to cement companies. (Section 3.7)
- Inspecting export shipments for quality and weight compliance. (Section 3.8)
- Establishing an equitable scheme for sharing export benefits/burdens. (Section 3.9)
- Requesting incentives from government to meet export objectives. (Section 3.10)
- Engaging in other activities necessary for export objectives. (Section 3.11)
DOMESTIC MARKET REGULATION
- No new cement plant can be established or expanded without Authority approval. (Section 4)
- Its domestic regulation functions include:
- Establishing sales quotas, distribution areas, and marketing regulations. (Section 4.1)
- Advising the Price Control Council on uniform, reasonable cement prices. (Section 4.2)
- Inspecting plants for quality, inventory, sales, and compliance. (Section 4.3)
- Imposing penalties for violations of rules, quotas, or guidelines. (Section 4.4)
- Establishing a reporting system on production, distribution, and consumption. (Section 4.5)
- Negotiating bulk purchases of common materials for cost reduction. (Section 4.6)
DELEGATION OF POWERS
- The Authority may delegate its powers to industry associations or companies. (Section 5)

PRESIDENTIAL DECREE No. 94 January 11, 1973
CREATING THE CEMENT INDUSTRY AUTHORITY
WHEREAS, it is to the national interest that all installed industrial productive capacity be utilized fully in order to hasten the economic development of the country;
WHEREAS, the cement industry in particular, in which the government has investments and guarantees exceeding one billion pesos, has a productive capacity far in excess of the present and expected domestic requirements for cement in the next few years;
WHEREAS, there exists a substantial foreign market for cement which could be tapped by the Philippine Cement Industry thus utilizing its idle capacity and generating needed foreign exchange for the country;
WHEREAS, a concerted and determined effort is necessary in order to expand the export market for Philippine cement;
WHEREAS, an orderly and stable domestic market is a desirable base for the development and maintenance of a substantial export market;
