Summary of Executive Order No. 537Creation of the Garments and Textile Export Board
- The Garments and Textile Export Board is created under the Office of the President. (Section 1)
- It is composed of the Minister of Trade (Chairman), Minister of Industry, and Commissioner of the Bureau of Customs. (Section 1)
- It replaces the previous Garments and Textile Export Board created under Presidential Decree No. 1440. (Section 1)
Statement of Policies
- Quota allocations shall not create monopolies for individuals or firms. (Section 2a)
- New manufacturers shall be given equitable shares in quota allocations. (Section 2b)
- Performance shall be assessed based on manufacturer's in-plant capacities, and sub-contractors may be entitled to quotas. (Section 2c)
- Quotas shall not be given to middlemen or traders. (Section 2d)
- Partly finished garments or worked textiles shall not be imported and exported as Philippine products under quota/restraint level. (Section 2e)
- The Board, through the Commissioner of Customs and/or investigating agencies, shall examine textile shipments, including importations of raw materials and supplies for export products under quota/restraint level. (Section 2f)
Powers and Functions of the Board
- Oversee the implementation of garments and textile agreements with other countries, particularly the administration of quotas. (Section 3a)
- Approve quota allocations and export authorizations, issue export licenses, and adopt measures to expedite processing. (Section 3b)
- Provide information and statistics relating to quota administration and export flow for monitoring and maximizing benefits from textile negotiations. (Section 3c)
- Promulgate and implement rules and regulations to administer international textile agreements, in pursuance of the policies enumerated in Section 2. (Section 3d)
- Fix and collect reasonable fees for the issuance of export quotas, authorizations, licenses, and other related services, in accordance with rules and regulations. (Section 3e)
Secretariat
- The Board is authorized to create a Secretariat composed of technical and administrative staff to assist the Board. (Section 4)
- The Secretariat shall hold office in the Ministry of Trade. (Section 4)
- It shall be headed by an Executive Director appointed by the President upon recommendation of the Chairman. (Section 4)
- The professional and technical personnel of the Secretariat shall be permanent and career in status. (Section 4)
Powers and Functions of the Chairman
- The Executive Director and Secretariat shall be responsible to the Board, but the Chairman shall exercise direct supervision and control over them. (Section 5)
- The Chairman shall appoint and discipline personnel of the Secretariat, subject to confirmation by the Board. (Section 5)
- The Chairman shall approve the agenda, convene and preside over meetings, and exercise other functions delegated by the Board. (Section 5)
- The Chairman shall designate an officer-in-charge to act as Executive Director when the position is vacant or the incumbent is incapacitated. (Section 5)
Appropriations
- One Million Pesos (P1,000,000.00) is appropriated to defray organizational and operational expenses of the Board for the calendar year 1979. (Section 6)
- Necessary sums to support the operation of the Board shall be included in the Annual Appropriations Acts. (Section 6)
Per Diems
- The Chairman and Members of the Board shall receive a per diem of Two Hundred Fifty Pesos (P250.00) for every meeting attended, subject to a maximum of One Thousand Pesos (P1,000.00) per month. (Section 7)
Penalties
- The Board is authorized to prescribe appropriate penalties for violations of the rules and regulations promulgated by it. (Section 8)
Repealing Clause
- This Order repeals Presidential Decree No. 1440 and all laws, orders, decrees, or rules inconsistent with its provisions. (Section 9)
Effectivity
- This Order shall take effect immediately. (Section 10)

CREATING THE GARMENTS AND TEXTILE EXPORT BOARD, DEFINING ITS POWERS AND FUNCTIONS, PROVIDING FUNDS THEREFOR AND FOR OTHER PURPOSES
WHEREAS, it is the policy of the government to develop and promote exports essential for the maintenance of a sustained economic growth, generating the much needed foreign exchange and the maintenance of a stable position in international reserves;
WHEREAS, an increasing number of countries seek to impose restraint levels on Philippine exports of textiles and garments under the Arrangement regarding the international Trade in Textiles also known as the Multi-Fibre Agreement;
WHEREAS, the Philippines has concluded several international trade agreements for the export of textiles and garments with other countries;
WHEREAS, there is a need to insure an equitable allocation of export quotas and authorizations to both old and new garments and textile manufacturers to maximize and spread the economic benefits to be derived from such international Agreements; and
WHEREAS, there is also a need to insure proper, order, and expeditious implementation of said Agreements and effect efforts in...
