PRESIDENTIAL DECREE No. 933 May 13, 1976

CREATING THE HUMAN SETTLEMENTS COMMISSION

WHEREAS, it is a declared objective of the New Society to effect social, economic and political reforms attuned to the establishment of a secure national community and to an improved quality of life for all citizens and for all others who may sojourn upon our shores;

WHEREAS, human settlement is an integrative concept embracing the interdependence of man's environment, human shelters and structures, and the design and organization of human communities consistently with a national framework plan, all for the people's security and well-being.

WHEREAS, the quality of human life in our times is inescapably determined by the relationship amongst human populations, resources, the environment, and intelligent policies;

WHEREAS, our programs or reform now call for the organization of a body that is adequate and responsive to the manifold tasks of formulating human settlements perspectives and policies, designing operational programs for the control of all forms of environmental blight or deterioration, and adopting and implementing...

Summary of Presidential Decree No. 933

Declaration of Policies (Section 1):
- Liberate human communities from blight, congestion, and hazards, and promote their development and modernization.
- Promote optimum use of land as a national resource for public welfare.
- Effect rational interdependence of communities within and across regions.
- Preserve a dynamic balance between physical beauty and human technology.
- Realize these policies through the human settlements approach, engaging public and private sectors.

Definitions (Section 2):
- Defines terms such as "Development Plan", "Human Settlements", "Human Settlements Approach", "Human Settlements Plan", "Land Resource Management", "Local Planning Bodies", "Physical Planning", "Pilot or Experimental Projects", "Planned Area for New Development", and "Regional Planning Bodies".

Creation of the Human Settlements Commission (Section 3):
- Establishes the Human Settlements Commission under the Office of the President.
- Outlines the composition of the Commission, including representatives from various government agencies.
- Authorizes the Commission to create working sub-committees and appoint staff.
- Transfers relevant functions and personnel from existing agencies to the Commission.

Functions of the Commission (Section 4):
- Formulate a multi-year integrated national plan on human settlements.
- Undertake studies and develop technologies related to human settlements.
- Conduct public hearings on human settlements plans.
- Promulgate rules and regulations to ensure compliance with policies and plans.
- Act as an appellate body for conflicting decisions of regional and local planning agencies.
- Recommend and develop Planned Areas for New Development with the President's approval.
- Promote, encourage, and assist private and public entities in human settlements programs.
- Promulgate guidelines, standards, and reporting systems for monitoring physical planning activities.
- Call on government agencies and private entities for cooperation and assistance.
- Adopt rules and procedures for its operations.
- Perform other necessary activities for effective performance of functions.

National Planning Functions (Section 5):
- Submit integrated national multi-year and annual Human Settlements Plans to NEDA for coordination and integration with the national development plan.
- Submit proposed draft legislation for implementation of plans, if necessary.
- Ensure conformity of government and private sector plans with approved Human Settlements Plan.

Regional Planning Functions (Section 6):
- Consult and coordinate with NEDA for integration of economic and physical planning.
- Prepare regional plans or provide technical assistance to Regional Development Councils (RDCs) upon request.
- Assist RDCs in establishing physical planning units.

Project Implementation (Section 7):
- The Commission may undertake pilot or experimental projects with NEDA's concurrence.
- The Commission may designate government agencies, private organizations, or qualified groups to undertake pilot projects.

Regulatory Functions (Section 8):
- Assist and coordinate with the National Pollution Control Commission (NPCC) in setting performance standards for emitants, industrial wastes, and safety devices.
- Formulate national standards, rules, and regulations for regional and local planning authorities.
- Formulate regional standards and guidelines on land use, classification, and readjustment schemes in coordination with RDCs.
- Provide model ordinances and development regulations for guidance of regional and local planning authorities.
- Require concurrence of the Commission for local physical or zoning plans to ensure consistency with national and regional standards.

General Powers of the Commission (Section 9):
- Enter into contracts, domestic or foreign.
- Receive, hold, and convey assets, grants, or property.
- Develop and maintain a responsive information system and data bank.
- Perform any necessary acts to carry out the objectives of the Decree.

Powers of the Commission Upon Notice and Hearing (Section 10):
- Formulate national and regional human settlements plans.
- Formulate plans showing areas for the location of factories, plants, and industries subject to regulations.

Powers of the Commission Without Hearing (Section 11):
- Require persons, corporations, or entities to furnish relevant information.
- Issue subpoenas and subpoenas duces tecum for inquiries, studies, hearings, or investigations.
- Call on government agencies for cooperation and assistance.
- Promulgate rules and regulations relevant to procedures and enforce compliance.
- Issue and promulgate necessary rules and regulations.
- Perform other necessary acts for the exercise of functions and discharge of duties.

Submission of Annual Reports (Section 12):
- The Commission shall render an Annual Report and other necessary reports to the Office of the President.

Commission Procedure (Section 13):
- Inquiries, studies, hearings, investigations, and proceedings shall be governed by rules adopted by the Commission.
- The Commission may summarily punish for contempt with a fine not exceeding P500 or imprisonment not exceeding 30 days, or both.
- The Commission may seek assistance from law enforcement agencies to enforce its orders.

Review of Commission's Decision or Order (Section 14):
- A party adversely affected by a Commission decision or order may appeal to the Office of the President within 30 days.
- A motion for reconsideration filed with the Commission suspends the appeal period.

Penalties (Section 15):
- Providing false or misleading data or concealing material facts in proceedings shall be punished with imprisonment of 4 to 6 months and a fine of P500 to P1,000.
- Violations of the Decree or Commission orders shall result in warnings, probation, withdrawal of infrastructure support, and imprisonment of 6 months to 5 years with a fine of at least P5,000 for subsequent convictions.

Domicile (Section 16):
- The principal office of the Commission shall be established in Metropolitan Manila, with possible branches in other locations.

Appropriation (Section 17):
- The budget of the Commission for calendar year 1976 is P29,000,000, appropriated from the National Treasury.
- Subsequent necessary amounts shall be included in the Annual Appropriations Act.

Separability Clause (Section 18):
- If any provision is held invalid, the remainder shall not be affected.

Repealing Clause (Section 19):
- Any inconsistent provisions of law, executive order, rule, or regulation are repealed or modified accordingly.

Effectivity (Section 20):
- This Decree shall take effect immediately.
