CREATING THE MARCOS GOLF FOUNDATION OF THE PHILIPPINES, DEFINING ITS OBJECTIVES, POWERS, FUNCTIONS AND FOR OTHER PURPOSES
WHEREAS, it is the declared objectives of the Government to pursue and implement the programs of total sports development;
WHEREAS, golf is an international sport wherein Filipinos may be able to compete credibly without regard to height and build; and
WHEREAS, to facilitate the development of golf, there is a necessity of creating a foundation to take care of the improvement of golf in the Philippines;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree;
Section 1. Name and Location. There is hereby created a body corporate to be known as the Marcos Golf Foundation of the Philippines, hereinafter referred to as the Foundation, with its main executive offices in Metro Manila.

Creation of the Marcos Golf Foundation of the Philippines

- Standardize the conduct of playing golf and oversee all golf associations and clubs
- Make standard rules for playing golf within the context of the ancient rules of golf
- Raise funds through fees, donations, contributions, and other lawful means
- Provide incentives for the development of golf
- Conduct local and international competitions for the promotion of golf
- Perform other functions necessary for accomplishing its objectives
Governing Body (Section 3)
- Board of Trustees composed of a Chairman and four other members appointed by the President of the Philippines
- Board may appoint an Executive Officer
Functions of the Board (Section 4)
- Adopt a constitution and by-laws for internal organization
- Facilitate with international or regional golf associations
- Purchase, sell, lease, or encumber properties for accomplishing objectives
- Conduct local, inter-region, or international competitions for promoting golf
- Discipline erring members for misconduct and willful violations
- Appoint representatives to represent the country in foreign competitions
- Render an annual report to the President regarding finances and activities
- Perform other acts necessary for implementing the Foundation's objectives
Membership (Section 5)
- Foundation shall have professional and amateur golf players as members
- Members classified according to individual ability
- Foundation is the umbrella of all golf associations in the Philippines
- Individuals or golf associations in the Philippines may apply for membership
Admission (Section 6)
- Application for membership made in proper form provided by the Foundation
- Application accompanied by required information
- Members required to pay monthly or yearly dues as determined by the Foundation
Duties and Obligations of Members (Section 7)
- Members must uphold the constitution, by-laws, and rules of the Foundation
- Members must abide by decisions of the Board of Trustees within its jurisdiction
Disciplinary Action (Section 8)
- Members who willfully and continuously fail to comply with obligations may be suspended or expelled by a vote of three Board members, after due notice and opportunity to be heard
- Members may be expelled for dishonesty, disloyalty, gross misconduct, willful violation of rules, or acts inimical to the Foundation's interests and objectives
Exemption from Taxes (Section 9)
- Donations, contributions, bequests, subsidies, or financial aid to the Foundation are exempt from taxes and constitute allowed deductions for income tax purposes
- Cash prizes awarded in professional tournaments sanctioned by the Foundation are exempt from all taxes
- Foreign contributions or donations to the Foundation constitute allowable deductions from income tax for the donor's branch, affiliate, or subsidiary corporation doing business in the Philippines
- The Foundation, its assets, acquisitions, income, operations, and transactions are exempt from all taxes, fees, duties, charges, imposts, licenses, and assessments imposed by the Republic of the Philippines or any of its instrumentalities, political subdivisions, or taxing authorities
Effectivity Clause (Section 10)
- This Decree shall take effect immediately
