PRESIDENTIAL DECREE No. 824 November 7, 1975

CREATING THE METROPOLITAN MANILA AND THE METROPOLITAN MANILA COMMISSION AND FOR OTHER PURPOSES

WHEREAS, in the referendum held on February 27, 1975, the residents of the Greater Manila Area authorized the President to restructure the local governments of the four cities and 13 municipalities thereof into an integrated unit of the manager or commission form of government, under such terms and conditions as the President may decide;

WHEREAS, the rapid growth of population and the corresponding increase of social and economic requirements in the contiguous communities referred to above has brought into being a large area that calls for simultaneous and unified development;

WHEREAS, many public services now rendered by local governments separately for themselves may and should be administered more efficiently and more economically, to the common benefit of the cities and municipalities in the area, if they are integrated and harmonized, under a system of central planning which would take separate municipal needs into account as...

Summary of Presidential Decree No. 824

Creation of Metropolitan Manila
- Creates a public corporation called Metropolitan Manila, administered by a Commission. (Section 1)
- Covers the cities of Manila, Quezon, Pasay, Caloocan, and the municipalities of Makati, Mandaluyong, San Juan, Las Piñas, Malabon, Navotas, Pasig, Pateros, Parañaque, Marikina, Muntinlupa, Taguig, and Valenzuela. (Section 2)

Organization and Personnel of the Commission
- The Commission consists of a Chairman/Governor, Vice-Chairman/Vice-Governor, and three Commissioners for Planning, Finance, and Operations, appointed by the President. (Section 3)
- Specifies the annual salaries of the Chairman/Governor (₱60,000), Vice-Chairman/Vice-Governor (₱50,000), and Commissioners (₱45,000 each). (Section 3)
- Heads of departments and personnel are appointed by the Chairman/Governor, with compensation fixed by the Commission. (Section 3)
- Non-presidential appointees have security of tenure and can only be removed for cause, following Civil Service rules. (Section 3)

Powers and Functions of the Commission
- Act as a central government to establish and administer programs and provide common services. (Section 4.1)
- Levy and collect taxes, special assessments, borrow and expend money, and issue bonds and other obligations. Existing tax measures continue until modified or repealed by the Commission. (Section 4.2)
- Charge and collect fees for public service facilities. (Section 4.3)
- Appropriate money for the metropolitan government and review appropriations of local government units, with authority to disapprove if not in accordance with Commission policies. (Section 4.4)
- Review, amend, revise or repeal ordinances, resolutions, and acts of local government units within Metropolitan Manila. (Section 4.5)
- Enact or approve ordinances, resolutions, and fix penalties for violations not exceeding ₱10,000 fine or 6 years imprisonment, or both. (Section 4.6)
- Perform general administrative, executive, and policy-making functions. (Section 4.7)
- Establish fire control, garbage disposal, and transport and traffic operation centers to direct respective services. (Sections 4.8-4.10)
- Coordinate and monitor governmental and private activities related to essential services. (Section 4.11)
- Ensure comprehensive social, economic, and physical planning and development of the area. (Section 4.12)
- Study feasibility of increasing barangay participation and propose programs and policies to the President. (Section 4.13)
- Submit annual and periodic reports to the President. (Section 4.14)
- Perform other tasks assigned by the President. (Section 4.15)

Functions of the General Manager
- Execute policies and measures approved by the Commission and be responsible for efficient management. (Section 5.1)
- Submit policies and measures to the Commission. (Section 5.2)
- Prepare staffing pattern, appoint and fix compensation of subordinate officials and employees, and suspend, discipline, or remove them for cause, subject to Commission approval. (Section 5.3)
- Prepare annual report on Commission activities and submit to the President. (Section 5.4)
- Submit annual budget for Commission operations to the Commission for approval. (Section 5.5)
- Perform other duties assigned by the Commission. (Section 5.6)

Functions of the Commissioner for Planning
- Formulate long-range plans for integration of common, essential, municipal, and public services, and submit to the General Manager for approval. (Section 6.1)
- Translate policy directives into detailed operational plans and programs. (Section 6.2)
- Undertake research, investigations, and other activities on policy areas, and submit reports and recommendations to the General Manager. (Section 6.3)
- Perform other planning-related functions assigned by the Commission or General Manager. (Section 6.4)

Functions of the Commissioner for Finance
- Determine financial requirements for the integration of common, essential, municipal, and public services. (Section 7.1)
- Determine sources of and allocate funds for the integration. (Section 7.2)
- Conduct continuous and detailed financial analysis of the integration. (Section 7.3)
- Perform other finance-related functions assigned by the Commission or General Manager. (Section 7.4)

Functions of the Commissioner for Operations
- Maintain a monitoring system for execution and compliance with approved policies and plans, and evaluate performance based on time schedule and costs. (Section 8.1)
- Perform other operations-related functions assigned by the Commission or General Manager. (Section 8.2)

Transition Provisions
- Existing city and municipal governments continue to exist, except as inconsistent with the Decree. (Section 9)
- Members of existing city and municipal councils become members of the Sangguniang Bayan until December 31, 1975, along with barangay captains and representatives from other sectors appointed by the President upon Commission recommendation. (Section 9)
- Sangguniang Bayan members receive per diems and allowances, not regular salaries, as fixed by the Commission. (Section 9)
- Sangguniang Bayan can recommend ordinances, resolutions, or measures to the Commission, but they only become effective after Commission approval. Taxation, appropriation, and penal ordinances are vested exclusively in the Commission. (Section 9)

Functions of Local Chief Executives
- Implement integration of common, essential, municipal, and public services approved by the Commission in their respective local government units. (Section 10.1)
- Furnish information to the Commission and assist in carrying out the integration. (Section 10.2)
- Perform other functions directed by the Commission. (Section 10.3)

Financial Provisions
- City or municipal treasurers to close books of accounts by December 15, 1975, after which their functions are performed by the Commissioner for Finance. (Section 11)
- Commission's financial resources include ₱2,500,000 appropriation, proceeds of franchise taxes, fixed/privilege taxes on occupation, corporate residence taxes from local government units in the metropolitan area, and other sources authorized by the President. (Section 12)
- Necessary funds for Commission operations to be included in the General Appropriations Decree. (Section 12)

Supervision and Control
- The Commission, General Manager, and officials are under the direct supervision and control of the President. (Section 13)
- The President has the power to revoke, amend, or modify any ordinance, resolution, or act of the Commission, General Manager, and Commissioners. (Section 13)

Review and Assessment
- The Commission shall submit a special report with recommendations to the President to assess the efficacy of the integration of governmental functions and services, with the aim of establishing a more responsive and effective government for Metropolitan Manila. (Section 14)

Repealing Clause and Effectivity
- All laws, executive orders, or regulations inconsistent with the Decree are repealed or modified accordingly. (Section 15)
- The Decree takes effect immediately, except for provisions indicated otherwise. (Section 16)
