PRESIDENTIAL DECREE No. 1240

CREATING THE MUNICIPALITY OF JOSEFINA IN THE PROVINCE OF ZAMBOANGA DEL SUR

WHEREAS, the fundamental aim of the government is to provide every possible opportunity and facility to accelerate the pace of progress throughout the country not only in the areas where economic development lagged out but likewise in places where political reasons, among others, constitute a stumbling block toward the realization of the ideals of the New Society;

WHEREAS, the necessity is felt, in order to maximize the efficacy of law and order and to expedite optimum development in the proposed municipality as same would enhance the progress and development of the localities involved for, in this regard, government projects would be subjected to closer attention of local officials;

WHEREAS, the creation of the proposed municipality will redound and contribute greatly to the maintenance of the peace and order and to the pacification drive to restore normalcy in the area; and

WHEREAS, the proposed municipality will become a self-reliant community once...

Summary of Presidential Decree No. 1240

Creation of the Municipality of Josefina
- Barangays Bogo Calabat, Sebucang, Nopolan, Lower Bag-ong Tudela, Leonardo, Gumahan, Mansanas, Nemenio, Moradje, Dawa, Tagaytay Hill, Litapan and Ebarle are detached from the Municipality of Tambulig, Zamboanga del Sur to form the new Municipality of Josefina. (Section 1)
- The seat of government of Josefina shall be in Barangay Gumahan. (Section 1)
- The boundaries of Josefina are specifically defined. (Section 1)

Applicability of Laws
- Except as provided, all laws applicable to regular municipalities shall apply to Josefina. (Section 2)

Transition of Officials and Employees
- The current elective municipal officials of Tambulig shall continue to perform their duties in Josefina until new officials are appointed by the President. (Section 3)
- The appointed officials shall hold office until their successors are elected in the next regular elections and have qualified, unless sooner removed by the President. (Section 3)
- Necessary appointive officers and employees shall be appointed to organize the government of Josefina as provided by existing laws. (Section 3)

Transfer of Assets and Liabilities
- Upon effectivity of the Decree, Josefina's proportionate share of obligations, funds, assets and other property of Tambulig shall be transferred by the President upon recommendation of the Commission on Audit. (Section 4)

Repealing Clause
- All laws, executive orders or regulations inconsistent with the Decree are repealed or modified accordingly. (Section 5)

Effectivity
- The Decree shall take effect immediately. (Section 6)
