PRESIDENTIAL DECREE No. 1509

CREATING THE NATIONAL COMMISSION CONCERNING DISABLED PERSONS AND FOR OTHER PURPOSES

WHEREAS, the national government recognizes its responsibility to provide the handicapped with the fullest measure of protection and assistance to help develop their abilities in all fields of endeavor and to promote their integration into the mainstream of society, as well as its primary duty for the prevention of physical and mental disabilities;

WHEREAS, the national government is also cognizant of the limitations of the existing system for delivery of services to the handicapped in this country and of the pressing need for the creation and development of new facilities to extend the range of rehabilitation services, as well as the expansion of existing ones to meet actual needs;

WHEREAS, there is an increasing awareness by the citizenry of the national problem of disability and of their joint responsibility with the government to be involved in the national effort to seek solutions to the problems;

Summary of Presidential Decree No. 1509

Declaration of Policy (Section 1):
- The Philippine government accepts and supports the UN resolution on disability as an economic and social issue requiring government action.

Creation of National Commission Concerning Disabled Persons (Section 2):
- A National Commission is created under the Office of the President.

Objectives of the Commission (Section 3):
- Prepare a comprehensive National Rehabilitation Plan to protect rights, provide services, and prevent disability. (Section 3a)
- Ensure programs and services are universally accessible. (Section 3b)
- Conduct studies on rehabilitation services, problems, and causes of disability. (Section 3c)
- Propose new policies and legislation related to disability. (Section 3d)
- Act as overall coordinating body for government agencies, private entities, and international organizations. (Section 3e)
- Establish and maintain international contacts on disability issues. (Section 3f)
- Act as consultative and advisory body to the President. (Section 3g)
- Ensure participation of disabled persons in rehabilitation process. (Section 3h)
- Educate and reorient public attitudes towards the disabled. (Section 3i)

Powers and Functions of the Commission (Section 4):
- Monitor and evaluate projects, programs, and activities for compliance. (Section 4a)
- Undertake research studies and surveys on rehabilitation topics. (Section 4b)
- Conduct public hearings, conferences, or meetings as needed. (Section 4c)
- Maintain educational, training, and information programs. (Section 4d)
- Maintain implementing mechanisms for coordination. (Section 4e)
- Prepare periodic reports to the President. (Section 4f)
- Seek assistance from government agencies for resources. (Section 4g)
- Supervise pilot demonstration projects and programs. (Section 4h)
- Establish standards and guidelines for rehabilitation facilities and programs. (Section 4i)
- Encourage setting up of information dissemination office. (Section 4j)
- Make recommendations for data banking system. (Section 4k)
- Encourage setting up of central reference office and referral system. (Section 4l)

Composition of the Commission (Section 5):
- Chaired by a Presidential appointee.
- Members include heads of government agencies, private sector representatives, and disabled persons.

Duties of the Chairman (Section 6):
- Call and preside over meetings, disburse funds, manage affairs, implement decisions, represent the Commission, accept gifts/donations, organize committees.

Secretariat (Section 7):
- Philippine Foundation for the Rehabilitation of Disabled, Inc. will serve as Secretariat.
- Headed by the Foundation's Executive Director as Action Officer and Secretary.
- Foundation will be reimbursed for costs of service.

Meetings (Section 8):
- Board to meet monthly or as called by the Chairman.
- Quorum of 5 members, with unanimous vote required for decisions.
- Members receive allowances but no compensation.

Appropriations (Section 9):
- Initial operating funds of 1,500,000 pesos appropriated.
- Subsequent funding to be included in annual appropriations.

Donations (Section 10):
- Commission authorized to receive grants, donations, contributions, or gifts.
- Donations exempt from customs duties, income and gift taxes, and fully deductible.

Definition of Terms (Section 11):
- Disability: lack or impairment of physical/mental function limiting independent living.
- Handicap: disadvantage making achievement difficult due to impairment.
- Rehabilitation: restoring disabled to maximum functional usefulness within limitations.
