EXECUTIVE ORDER No. 470

CREATING THE PHILIPPINE COUNCIL FOR MENTAL HEALTH

WHEREAS, the Philippine Constitution provides that the State shall protect and promote the right to health of the people, instill health consciousness among them and adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost;

WHEREAS, the World Health Organization (WHO) wholistically defines health as the state of physical, social and mental well-being, rather than merely the absence of physical diseases. Good mental health means not simply the absence of detectable mental disorder but a state of well-being in which the individual is able to utilize his abilities, work productively and fruitfully and contribute to the community;

WHEREAS, the scope of Mental Health covers not only mental disorders and substance (drug and alcohol) abuse but also other mental health-associated issues and problems, such as those arising from a) medical illnesses; b) psychosocial issues of daily living; c) being part of high risk groups...

EXECUTIVE ORDER No. 470

Creating the Philippine Council for Mental Health

- Recognizes the constitutional right to health and the WHO's definition of health as a state of physical, social, and mental well-being. (Preamble)
- Defines the scope of mental health to cover mental disorders, substance abuse, and other mental health-associated issues. (Preamble)
- Identifies the need to improve public awareness of mental health and ensure its inclusion in government health care programs. (Preamble)

Composition of the Council (Section 1):
- Chaired by the Secretary of Health.
- Members include secretaries from various departments (Social Welfare and Development, Education, Culture and Sports, Justice, Labor and Employment, Interior and Local Government), heads of mental health institutions (National Center for Mental Health, UP-PGH Department of Psychiatry), and representatives from non-government organizations concerned with mental health.

Functions of the Council (Section 2):
- Formulate policies and guidelines on mental health issues and concerns. (Section 2a)
- Develop a comprehensive and integrated national plan on mental health. (Section 2b)
- Conduct periodic monitoring, evaluation, and research in support of policy formulation and planning on mental health. (Section 2c)
- Promote and facilitate collaboration among sectors and disciplines for the design, development, and implementation of sectoral mental health plans. (Section 2d)
- Review existing laws related to mental health and recommend legislation to sustain and strengthen programs, services, and initiatives. (Section 2e)
- Advise the President in the field of mental health. (Section 2f)
- Submit an annual report to the President. (Section 2g)

Institutional Support (Section 3):
- The Council is authorized to call upon any government department, bureau, office, or instrumentality, including government-owned and controlled corporations (GOCCs), to extend necessary assistance.
- The Department of Health (DOH) shall provide technical, administrative, and secretariat support to the Council.

Funding (Section 4):
- The Council shall derive its funding from the DOH 1998 budget.
- Appropriations for succeeding years shall be incorporated into the regular budget of the DOH.

Effectivity (Section 5):
- This Executive Order shall take effect immediately.
