EXECUTIVE ORDER NO. 118 May 11, 1990
CREATING THE PRESIDENTIAL COMMISSION ON CULTURE AND ARTS
RECALLING that the reorganization of the government is mandated expressly in Article II, Section 1 (a), and Article III of the Freedom Constitution;
HAVING IN MIND that pursuant to Executive Order No. 5 (1986), it is directed that necessary and proper changes in the organizational and functional structures of the government, its agencies and instrumentalities, be effected in order to promote efficiency and effectiveness in the delivery of public services;
AFFIRMING the government is committed to fulfill its constitutional mandate of preserving and developing Philippine culture for national identity and of placing arts and letters under the patronage of the state;
MINDFUL of the fact that there is a need for a national body to articulate a national policy on culture, to conserve and promote national heritage, and to guarantee a climate of freedom, support and dissemination for all forms of artistic and cultural expression;

Executive Order No. 118
Summary of Executive Order No. 118 - Creating the Presidential Commission on Culture and Arts
Mandate and Objectives (Section 3):
- Formulate and maintain national policy, support, and dissemination frameworks for culture and arts.
• Foster national identity and pride through conservation and promotion of cultural patrimony and national heritage. (Section 3a)
• Develop and guarantee climate of freedom and support for multi-cultural and pluralistic growth of all art forms. (Section 3b)
• Encourage and assist various forms of artistic and cultural expression, in cooperation with private sector. (Section 3c)
• Work with government and non-government agencies in national and international dissemination of culture and arts. (Section 3d)
Powers and Functions (Section 4):
• Establish a secretariat under Deputy Minister for Culture as Executive Director. (Section 4a)
• Conduct consultations and meetings with cultural and artistic subsectors for establishing national councils and ensuring people participation. (Section 4b)
• Coordinate with government and non-government artistic and cultural institutions, and call upon any government agency for assistance. (Section 4c)
• Encourage participation of national councils in formulating strategies, policies, plans, programs, projects, funding requirements, and organizational changes for each subsector. (Section 4d)
• Articulate national policies, promulgate rules and regulations, and carry out activities for preservation of cultural heritage and development of Philippine culture and arts. (Section 4e)
• Authorize and effect institutional or organizational transfers, mergers, or changes recommended by councils or National Advisory Board. (Section 4f)
• Assist in generating resources, governmental and non-governmental, local, national and international, for development, protection, preservation, or dissemination of Philippine culture and arts. (Section 4g)
National Committees (Section 5):
- Responsible for formation, operations, maintenance, and coordination of 14 national committees grouped into 3 sub-commissions:
• Sub-Commission on Cultural Heritage:
1. National Committee on Libraries and Archives
2. National Committee on Museums and Galleries
3. National Committee on Shrines and Monuments
• Sub-Commission on the Arts:
4. National Literary Arts Committee
5. National Visual Arts Committee
6. National Dramatic Arts Committee
7. National Broadcast Arts Committee
8. National Music Committee
9. National Dance Committee
10. National Film Committee
• Sub-Commission on Cultural Dissemination:
11. National Committee on Language and Translation
12. National Committee on Cultural Events
13. National Committee on Ethnic Culture and Traditional Arts
14. National Committee on Cultural Education
- Chairpersons of 14 committees shall form National Advisory Board to the Commission.
Structure and Staffing (Section 6):
• Position structure and staffing pattern to be approved and prescribed by Chairman within 120 days.
• Authorized positions to be filled with regular appointments by Chairman or President.
Performance Evaluation (Section 7):
• Chairman required to formulate and enforce system of measuring and evaluating Commission's performance periodically and objectively.
• Performance report to be submitted annually to the President.
Notice or Consent Requirement (Section 8):
• If reorganizational change prejudices third parties' rights, notice to or consent of creditors must be complied with prior to implementation.
Prohibition Against Change (Section 9):
• No change in reorganization valid except upon prior approval of the President for promoting efficiency and effectiveness in public service delivery.
Funding (Section 10):
• Subject to availability of funds, Ten Million Pesos (P10,000,000.00) authorized to be set aside from National Treasury for Commission's expenditure.
Implementing Authority (Section 11):
• Chairman shall issue rules, regulations and other issuances necessary for effective implementation.
Separability (Section 12):
• Any unconstitutional portion shall not nullify other portions as long as remaining portions can still subsist and be given effect.
Repealing Clause (Section 13):
• All inconsistent laws, rules, regulations, other issuances or parts thereof are repealed or modified accordingly.
