Executive Order No. 125

EXECUTIVE ORDER NO. 125 September 15, 1993

DEFINING THE APPROACH AND ADMINISTRATIVE STRUCTURE FOR GOVERNMENT'S COMPREHENSIVE PEACE EFFORTS

WHEREAS, a primary objective of Government is the attainment of a just, comprehensive and lasting peace under the Rule of Law and in accordance with Constitution processes, which is the basic foundation for economic development and national prosperity;

WHEREAS, the National Unification Committee, by virtue of its mandate under Executive Order No. 19, has submitted recommendations to the President for the pursuit of a peace process envisioned to lead to a just, comprehensive and lasting peace in the country;

WHEREAS, the term of the National Unification Commission ended on 31 July 1993; and

WHEREAS, a comprehensive peace process demands a wholistic approach that will require the cooperative efforts of all sectors of society.

NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Defining the Approach and Administrative Structure for Government's Comprehensive Peace Efforts

I. Principles Underlying the Comprehensive Peace Process (Sec. 2)
- The peace process should be community-based, reflecting the sentiments, values, and principles important to all Filipinos. (Sec. 2a)
- It aims to forge a new social compact for a just, equitable, humane, and pluralistic society, establishing a genuinely pluralistic political society where individuals and groups can engage in peaceful competition for predominance of their political programs. (Sec. 2b)
- It seeks a principled and peaceful resolution of internal armed conflicts, with dignity for all concerned. (Sec. 2c)

II. Components of the Comprehensive Peace Process (Sec. 3)
- Pursuit of social, economic, and political reforms to address root causes of internal armed conflicts and social unrest. (Sec. 3a)
- Consensus-building and empowerment for peace through consultations and mobilization of people's participation. (Sec. 3b)
- Peaceful, negotiated settlement with different rebel groups through face-to-face negotiations. (Sec. 3c)
- Programs for reconciliation, reintegration into mainstream society, and rehabilitation of former rebels, demobilized combatants, and civilian victims. (Sec. 3d)
- Addressing concerns arising from continuing armed hostilities, including protection of non-combatants and reducing the impact on communities in conflict areas. (Sec. 3e)
- Building and nurturing a climate conducive to peace through peace advocacy, peace education, and confidence-building measures. (Sec. 3f)

III. Administrative Structure (Sec. 4)
- The President shall provide active leadership for the comprehensive peace process. (Sec. 4a)
- The Presidential Adviser on the Peace Process (PAPP) shall manage and supervise the comprehensive peace process, with the rank and remuneration of a Cabinet member. (Sec. 4b)
- The National Reconciliation and Development Council (NRDC) shall implement the reconciliation program for surfacing rebels. (Sec. 4c)
- Government Peace Negotiating Panels (GPNPs) shall be appointed by the President to conduct negotiations with rebel groups, reporting directly to the President. (Sec. 4d)
- A Panel of Advisers, composed of members from the Senate, House of Representatives, and Cabinet, shall advise each GPNP on achieving a comprehensive, just, and lasting peace. (Sec. 4e)

IV. Secretariat and Support (Sec. 5)
- The PAPP shall be provided with technical and administrative support by a Secretariat. (Sec. 5)
- Each GPNP shall be provided technical support by a Negotiating Secretariat under the direct control and supervision of the respective Panel Chairmen. (Sec. 5)
- Administrative support services for the GPNPs shall be provided by the PAPP Secretariat. (Sec. 5)
- The PAPP and GPNPs shall be authorized to organize their own Technical Committees and hire consultants. (Sec. 5)

V. Funding (Sec. 6)
- The Office of the PAPP and the GPNPs shall be funded with an initial budget from the President's Contingent Fund, as recommended by the Department of Budget and Management and approved by the President. (Sec. 6)
- Appropriations for succeeding years shall be incorporated in budget proposals of the Office of the President. (Sec. 6)

VI. Agency Support (Sec. 7)
- The PAPP and the Chairmen of each GPNP are authorized to call on all government departments, agencies, and government-owned or controlled corporations to assist in the implementation of the comprehensive peace process. (Sec. 7)

VII. Implementing Rules and Regulations (Sec. 8)
- The PAPP shall promulgate the necessary implementing rules and regulations to carry out the provisions of this Executive Order, subject to the approval of the Office of the President. (Sec. 8)

VIII. Transition Mechanism (Sec. 9)
- Until the Secretariat for the peace process is fully organized and operational, the NUC Secretariat created under Executive Order No. 19 (s. 1992) shall continue to provide staff support to the PAPP and receive, disburse, and account for funds released for the peace process. (Sec. 9)
- All assets, funds, records, equipment, facilities, other properties, choses in action, as well as the personnel of the NUC Secretariat, are hereby transferred to the Secretariat of the PAPP. (Sec. 9)

IX. Repealing Clause (Sec. 10)
- All executive orders, rules and regulations, and other issuances or parts thereof, which are inconsistent with this Executive Order, are hereby repealed or modified accordingly. (Sec. 10)

X. Effectivity (Sec. 11)
- This Executive Order shall take effect immediately. (Sec. 11)
