EXECUTIVE ORDER No. 430 May 26, 2005
DELEGATING TO THE SECRETARY OF EDUCATION THE POWER TO EXERCISE OVERSIGHT FUNCTION OVER THE NATIONAL COMMISSION FOR CULTURE AND THE ARTS (NCCA)
WHEREAS, the National Commission for Culture and the Arts (Commission) was created under Republic Act No. 7356, approved on April 3, 1992;
WHEREAS, Section 8 thereof provides that "x x x The Commission shall be an independent agency and shall render an annual report of its activities and achievements to the President and to Congress";
WHEREAS, Executive power is vested in the President under Section 1, Article VII of the Constitution and under Section II, Chapter 3, Book II of Executive Order No. 292, otherwise known as the "Administrative Code of 1987;"
WHEREAS, Section 17, Article VII of the Constitution provides that the President shall have control of all executive departments, bureaus and offices and shall ensure that all laws be faithfully executed;

Executive Order No. 430
Delegation of Presidential Oversight Function over the National Commission for Culture and the Arts (NCCA) to the Secretary of Education
- The President delegates the power to exercise oversight function over the NCCA to the Secretary of Education. (Section 1)
- This power is derived from the President's constitutional authority to have control over executive departments, bureaus, and offices, and to ensure faithful execution of laws. (Basis: Section 17, Article VII of the Constitution)
- The NCCA is an independent agency created under Republic Act No. 7356, and is required to render an annual report to the President and Congress. (Basis: Section 8, Republic Act No. 7356)
- The President has continuing authority to reorganize the administrative structure of the Office of the President. (Basis: Section 31, Chapter 10, Title III, Book III of the Administrative Code of 1987)
- All other executive issuances, rules, and regulations inconsistent with this Executive Order are repealed, amended, or modified accordingly. (Section 2)
- This Executive Order takes effect immediately. (Section 3)
