EXECUTIVE ORDER NO. 771 December 1, 2008

DESIGNATING THE CABINET SECRETARY AS THE OVERSIGHT OFFICIAL ON MATTERS PERTAINING TO THE INDIGENOUS PEOPLE AND NATIONAL COMMISSION ON INDIGENOUS PEOPLES

WHEREAS, it is the policy of the State to protect the rights and welfare of the indigenous cultural communities and Indigenous Peoples (IPs), and to guarantee the respect for their cultural integrity as well as ensure that all members of indigenous cultural communities and IPs benefit on an equal footing from the rights and opportunities which national laws and regulations grant to other members of the population;

WHEREAS, essential to this policy is the effective and efficient functioning of the National Commission on Indigenous Peoples (NCIP), and its responsive implementation of Republic Act No. 8371, otherwise known as "An Act to Recognize, Protect and Promote the Rights of the Indigenous Communities/Indigenous Peoples";

Designating the Cabinet Secretary as the Oversight Official on Matters Pertaining to the Indigenous People and National Commission on Indigenous Peoples

- Policy of the State (Section 1):
    - Protect the rights and welfare of indigenous cultural communities and Indigenous Peoples (IPs)
    - Guarantee respect for their cultural integrity
    - Ensure equal rights and opportunities for IPs

- Effective and efficient functioning of the National Commission on Indigenous Peoples (NCIP) (Section 1)

- Responsive implementation of Republic Act No. 8371 (Section 1)

- Need for an Oversight Official with Cabinet rank (Section 1):
    - Coordinate and monitor efficient policy implementation
    - Provide policy and program recommendations to the President
    - Address issues and concerns affecting IPs and NCIP

- Constitutional basis (Section 1):
    - President has control of executive departments (Article VII, Section 17)
    - President can reorganize administrative structure (Executive Order No. 292, Section 31)

- Designation of Cabinet Secretary as Oversight Official (Section 1):
    - Coordinate implementation of policies and programs for IPs
    - Promote and protect rights and welfare of IPs
    - Ensure efficient functioning of NCIP

- Duties of Oversight Official (Section 2):
    - Coordinate and facilitate resolution of issues and concerns affecting IPs and NCIP
    - Submit regular reports to the President through the Executive Secretary

- Directive to government agencies (Section 3):
    - Extend support for efficient discharge of Oversight Official's duties

- Immediate effect (Section 4)
