DEVOLVING CERTAIN POWERS AND FUNCTIONS OF THE COOPERATIVE DEVELOPMENT AUTHORITY TO THE AUTONOMOUS REGIONAL GOVERNMENT OF THE AUTONOMOUS REGION IN MUSLIM MINDANAO
WHEREAS, it is the declared policy of the state to foster the creation and growth of cooperatives as a practical vehicle for promoting self-reliance and harnessing people power towards the attainment of economic development and social justice;
WHEREAS, all government instrumentalities, branches, subdivisions and agencies are mandated to provide technical guidance, financial assistance, and services to enable cooperatives to develop into viable and responsive economic enterprises and thereby bring about a strong cooperative movement that is free from any conditions that might infringe upon the autonomy or organizational integrity of cooperatives;
WHEREAS, in guidance with the state policy, the Organic Act (RA 6734) mandated the regional government to encourage and support entrepreneurial capability in the Autonomous Region in Muslim Mindanao (ARMM), and further recognizes the promotion, development, and the protection of cooperatives as a vehicle to foster cooperativism in accordance with Islamic principles and...

Devolution of Powers and Functions of the Cooperative Development Authority to the Autonomous Regional Government of ARMM
- Transfer of Powers, Functions and Responsibilities (Section 1):
• Formulate, adopt and implement plans and programs on cooperative development in ARMM. (Section 1.1)
• Develop and conduct management and training programs for cooperatives in ARMM. (Section 1.2)
• Support voluntary organization and development of cooperative movements. (Section 1.3)
• Coordinate with LGUs and private sector in promoting and developing cooperatives. (Section 1.4)
• Require cooperatives to submit annual financial statements and information sheets. (Section 1.5)
• Assist cooperatives in arranging financial and other forms of assistance. (Section 1.6)
• Administer grants and donations for cooperative development in ARMM. (Section 1.7)
• Mediate and conciliate disputes within or between cooperatives in ARMM. (Section 1.8)
• Formulate and adopt continuing policy initiatives through public hearings. (Section 1.9)
• Perform other functions necessary to implement cooperative laws. (Section 1.10)
- Regulatory Functions (Section 2):
• Registration and cancellation of cooperatives, and reporting requirements, shall be subject to a Memorandum of Agreement (MOA) between CDA and ARG.
- Standard Setting (Section 3):
• ARG shall formulate its own standards in accordance with existing laws, rules, regulations, local practices and traditions.
- Technical Assistance (Section 4):
• CDA shall provide technical assistance to ARG to carry out the objectives of this Executive Order.
- Implementing Rules (Section 5):
• CDA, in consultation with ARG, shall issue implementing rules and regulations within 60 days from effectivity.
- Quarterly Report (Section 6):
• Quarterly status report on implementation shall be submitted to the President.
- Shared Powers, Functions and Responsibilities (Section 7):
• Cooperative education, training, division, merger, consolidation and dissolution shall be jointly implemented and funded by CDA and ARG in accordance with the MOA.
- Separability Clause (Section 8)
- CDA-ARMM Extension Office (Section 9):
• CDA shall immediately establish an Extension Office in ARMM to perform shared and retained powers, functions and responsibilities during the one (1) year transition period.
- Effectivity (Section 10):
• This Order shall take effect fifteen (15) days after publication in a national newspaper and one newspaper in ARMM.
