DIRECTING THE ACCELERATION OF RESEARCH, DEVELOPMENT AND UTILIZATION OF NON-CONVENTIONAL ENERGY RESOURCES AND VESTING IN THE ENERGY DEVELOPMENT BOARD POWERS AND FUNCTIONS IN CONNECTION THEREWITH, AND FOR OTHER PURPOSES
WHEREAS, it is imperative to accelerate the development not only of indigenous conventional energy resources but also of those non-conventional alternatives which have great potential for immediate and future applications such as but not limited to solar, wind, tidal and bio-mass energy;
WHEREAS, it is essential in the interest of efficiency, economy and effectiveness to integrate in a single governmental entity the planning, coordination and control of the research, development and utilization efforts and programs in non-conventional forms of energy resources of the various government agencies and instrumentalities, including government owned and controlled corporations;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers and functions vested in me by the Constitution, do hereby order and decree the following as part of the law of the land:

Declaration of Policy (Section 1):
- Achieve self-reliance in the country's energy requirements through:
- Intensified exploration, development, exploitation and utilization of indigenous conventional energy resources (petroleum, coal, natural gas, water, geothermal, nuclear fuel)
- Non-conventional alternatives (solar, wind, tidal, bio-mass) with great potential
- Coordinate, integrate and control research, development and utilization efforts of all government agencies and instrumentalities pursuant to a comprehensive national energy program
Definitions (Section 2):
- Non-Conventional Energy Resources: Energy resources where conversion/utilization technology for large-scale applications is not well-developed or widely used (e.g., solar, tidal, nuclear converter/breeder reactors, fusion)
- Direct Solar Energy: Energy content of solar radiation harnessed by collecting sunlight in man-made devices (e.g., flat-plate or focusing solar collectors)
- Indirect Solar Energy: Energy content of solar radiation harnessed by initially collecting sunlight in a natural manner (e.g., winds, organic matter/bio-mass, ocean thermal gradients)
- Bio-mass: Organic matter, whether living or not (e.g., trees, algae, animal/agricultural wastes, decaying plants)
- Bio-conversion to Fuels: Processes (natural or synthetic) to produce solid, liquid or gaseous fuel from bio-mass feedstock (e.g., anaerobic fermentation of animal manure to yield bio-gas, combustion of firewood, fermentation of agricultural crops/by-products to yield substitute fuels like alcohol)
- Bio-gas: Fuel gas consisting of 50-70% methane and non-combustible gases produced by anaerobic fermentation of organic waste
- Energy Plantation: Scheme of deliberately and systematically planting fast-growing crops/trees (e.g., ipil-ipil) to continuously provide fuel to a power generating station at the site
- Comprehensive National Energy Program: Program of research, development or utilization of non-conventional energy resources approved by the Energy Development Board
Powers and Functions of the Energy Development Board (Section 3):
- Formulate and direct implementation of a comprehensive national energy program on non-conventional energy research, development and utilization (Section 3.1)
- Integrate, coordinate, direct and control all research, development and utilization efforts, programs and projects on non-conventional energy resources of all government agencies and instrumentalities (Section 3.2)
- Review and approve all ongoing or planned research, development and utilization projects on non-conventional energy, whether basic or applied, supported or planned to be supported by government funds or funds obtainable elsewhere through government intercession or assistance (Section 3.3)
- Formulate criteria for determining priority for proposed research, development and utilization projects on non-conventional energy resources and identify and select execution, financing and funding schemes (Section 3.4)
- Designate project implementors, coordinate and monitor progress of all projects and activities in the implementation of the comprehensive national energy program (Section 3.5)
- Provide necessary and appropriate supportive efforts (e.g., information and promotions drive, assistance and entry of suitable foreign expertise, training of Filipino personnel, proliferation of viable applications like bio-gas generation, windmills for water pumping and power generation from agricultural/industrial wastes, establishment of demonstration systems like solar water heaters/air-conditioning, energy plantations) (Section 3.6)
- Develop and implement specific programs requiring participation of government agencies/instrumentalities and the private sector (Section 3.7)
- Grant incentives provided for in the Decree and propose/recommend other necessary incentives to enterprises, industries and individuals who conduct research and development or apply available non-conventional energy technology (Section 3.8)
- Promulgate necessary rules and regulations to implement the objectives and provisions of the Decree (Section 3.9)
Incentives (Section 4):
- Costs incurred in establishing and constructing non-conventional energy conversion facilities or equipment certified by the Energy Development Board may be directly chargeable to expense and fully deductible from gross income in the year incurred (Section 4.a)
- Exemption from payment of tariff duties and compensating tax on importation of machinery, equipment, spare parts and materials required for establishing and constructing non-conventional energy facilities or equipment, subject to conditions (Section 4.b)
- Government financial institutions (e.g., Development Bank of the Philippines, Philippine National Bank, Government Service Insurance System, Land Bank of the Philippines) shall accord high priority to applications for financial assistance by individuals/enterprises/industries participating in the national program, as recommended and endorsed by the Energy Development Board (Section 4.c)
Assistance by Other Government Agencies/Offices and Corporations (Section 5):
- All government agencies and instrumentalities, including government-owned or controlled corporations, shall extend assistance required by the Energy Development Board, including detail of employees, scientists and technical personnel
Appropriations (Section 6):
- TEN MILLION PESOS (P10,000,000.00) appropriated from available funds in the National Treasury as operating funds of the Energy Development Board to carry out and implement the functions and objectives of the Decree from the effective date up to and including the fiscal year ending December 31, 1977
- Thereafter, amounts required by the Energy Development Board shall be included annually in the general Appropriation Decree
Repealing Clause (Section 7):
- All laws, decrees, orders, rules and regulations or parts thereof inconsistent with any provisions of this Decree are repealed or modified accordingly
Effectivity (Section 8):
- This Decree shall take effect immediately
