Encouraging Large Corporations to Provide for Rice Requirements of Their Employees

- Background and Rationale (Whereas clauses):
  - Global issues driving up prices of oil and food, particularly rice.
  - Administration's response based on three fundamental needs:
    1. Ensuring supply of rice.
    2. Ensuring efficient and cost-effective distribution of rice to those in need.
    3. Preventing diversion of subsidized rice for commercial sale.

- Provisions:
  - For a period recommended by NFA, but not less than 2 years, NFA shall encourage large corporations to provide rice requirements for employees by: (Section 1)
    1. Engaging in rice production as provided. (Section 1a)
    2. Importing rice to meet requirements. (Section 1b)
  - Definition of "large corporations": (Section 2)
    1. Corporations under Philippine laws with at least 500 employees.
    2. Reported earnings over the last 4 years allowing rice production/importation without affecting financial viability.
    3. NFA to generate list of qualified large corporations.
  - Corporations with suitable landholdings to engage in rice production within NFA-determined period. (Section 3)
  - Corporations without landholdings may lease public or private idle agricultural lands for rice production. (Section 3)
  - Corporations intending to import rice shall signify to NFA and follow import laws. (Section 3)
  - Corporations may register with NFA anytime during the Order's effectivity. (Section 3)
  - All importations under the Order shall be coursed through NFA, eligible for NFA fiscal privileges, but NFA may charge reasonable fees. (Section 4)
  - Excess rice production beyond employee consumption may be sold in local markets with NFA certification. (Section 5)
  - NFA to develop incentive package for effective implementation, in consultation with other agencies. (Section 6)
  - Corporations may enter into agreements or combinations for rice production/importation. (Section 7)
  - Moral suasion, not compulsion, shall be applied on corporations. (Section 8)
  - Immediate effectivity. (Section 9)

MALACAÑANG Manila BY THE PRESIDENT OF THE PHILIPPINES EXECUTIVE ORDER NO 721 &nbsp &nbsp &nbsp &nbsp &nbsp &nbsp May 2, 2008 ENCOURAGING LARGE CORPORATIONS TO PROVIDE FOR RICE REQUIREMENTS OF THEIR EMPLOYEES WHEREAS, there are global clouds on the horizon that are driving up the price of oil and food, particularly rice; WHEREAS, on the issue of rice management, this is a global problem that this Administration has seen coming, and has worked to head off for some time now; WHEREAS, this Administration’s response is based on three fundamental needs: 1. To ensure supply of rice; 2. To make sure distribution of rice gets to the people who need it most, efficiently and cost-effectively; 3. To be vigilant that unscrupulous vendors do not divert subsidized rice and sell it as commercial rice. NOW, THEREFORE, I, GLORIA M. ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and the law, do hereby order that: 1.
