Summary of Presidential Decree No. 1495Entitling Officers and Enlisted Personnel of the Armed Forces of the Philippines to Accumulate and Commute Leave Credits
- Officers and enlisted personnel of the Armed Forces of the Philippines can accumulate vacation and sick leave credits in excess of 10 months. (Section 1)
• Those currently in active service with more than 10 months of leave credits are entitled to only 10 months on the date of effectivity of this Decree.
- Military personnel prevented from going on leave due to exigencies of service can commute their leave credits and receive the cash value while still in active service, subject to the following conditions: (Section 2)
• They must have at least 5 months of leave credits that cannot be commuted.
• They can commute and receive the money value of not more than 2 months of leave credits per year.
• Excess leave credits can be carried forward, and the personnel can choose to continue working and receive corresponding pay and allowances or enjoy leave by utilizing non-commuted leave credits.
- Upon voluntary resignation, retirement, or discharge from service through no fault of their own, military personnel are entitled to the commutation of all accumulated vacation and sick leave credits, subject to a maximum of 10 months. (Section 3)
- The Secretary of National Defense shall formulate and adopt a systematic and integrated program for leaves due to military personnel, focusing on actual enjoyment of leaves or commutation of unused leaves. (Section 4)
- Funds necessary to carry out the purpose of this Decree shall be appropriated from the National Treasury or from savings of the Armed Forces of the Philippines, and shall be included in the yearly appropriation of the Armed Forces of the Philippines. (Section 5)
- Any inconsistent provisions of law, rules, and regulations are modified accordingly. (Section 6)
- This Decree shall take effect upon approval. (Section 7)

PRESIDENTIAL DECREE No. 1495
ENTITLING OFFICES AND ENLISTED PERSONNEL OF THE ARMED FORCES OF THE PHILIPPINES TO ACCUMULATE AND COMMUTE, SUBJECT TO CERTAIN CONDITIONS, LEAVE CREDITS, AND FOR OTHER PURPOSES
WHEREAS, officers and enlisted personnel of the Armed Forces of the Philippines, more than any other group of men in the government service, have been called upon to carry out the grave burden of providing the proper climate conducive to the attainment of the objectives of the New Society;
WHEREAS, in the fulfillment of this obligation and commitment, officers and enlisted personnel of the Armed Forces of the Philippines have given up certain privileges, like the privilege to go on leave periodically as granted by law, in view of the continuing need for their services for the preservation of peace and other throughout the land;
WHEREAS, this circumstances has resulted to the forfeiture, by military personnel, of leave credits beyond the maximum period of authorized under Section 286 of the Revised Administrative Code as amended by Republic Act Numbered...
