Establishment of Agro-Forest Reserves
- Withdraws denuded, logged-over, and inadequately stocked areas from the following timber concessions in Agusan del Sur:
    - Liberty Forest, Inc. (Sec. 1(i))
    - CVC Forest Industries (Sec. 1(ii))
    - Ago Timber Corporation (Sec. 1(iii))
    - CBL Timber Corporation (Sec. 1(iv))
- Establishes the withdrawn areas as agro-forest reserves for planting hybrid coconut seednuts and other agro-forest products, tree crops, and forest plants. (Sec. 1)

Agro-Forest Lease Agreements
- Authorizes the Philippine Coconut Authority (PCA) to enter into agro-forest lease agreements for the development of the agro-forest reserves with:
    - Coconut farmers of the Philippines, acting through the Coconut Industry Investment Fund and/or the Coconut Industry Development Fund. (Sec. 2)
    - Persons or entities who have availed of the provisions of Republic Act No. 926. (Sec. 2)
- The lease period is 25 years, renewable for another 25 years or longer if allowed by law. (Sec. 2)
- After the lease term, if the program is ongoing, the awardees shall be given priority for further utilization of the leased areas for agro-forest purposes. (Sec. 2)
- Other suitable forest areas may be incorporated into the agreements. (Sec. 2)
- All agreements entered into by PCA are subject to the President/Prime Minister's approval. (Sec. 2)

Nationwide Coconut Replanting Program
- The agro-forest reserves shall be incorporated into PCA's nationwide coconut replanting program. (Sec. 3)
- PCA shall determine the necessary terms and conditions for protecting the interests of the government, coconut farmers, and sellers and kaingeros in the area. (Sec. 3)

Infrastructure Development
- The Ministry of Public Highways shall construct and maintain the required infrastructure, such as roads and bridges, for the development of the areas and assist PCA as required. (Sec. 4)

Exceptions and Validity
- Qualified persons, entities, and agreements under this Decree are exempted from existing laws that may otherwise disqualify them or render the agreements invalid. (Sec. 5)
- If any provision is held invalid, the other provisions shall remain operative. (Sec. 6)

Effectivity
- This Decree shall take effect immediately. (Sec. 7)

MALACAÑANGM a n i l a PRESIDENTIAL DECREE No. 1768 ESTABLISHING AGRO-FOREST RESERVES WITHIN THE AGUSAN VALLEY FOR THE IMPLEMENTATION OF THE NATIONWIDE COCONUT REPLANTING PROGRAM WHEREAS, it is the policy of the State, as enunciated in PD No. 705 and PD No. 1153, to vigorously undertake a forest renewal program; WHEREAS, it is also the declared policy of the State under PD No. 1468 to promote the rapid integrated development and growth of the coconut industry, and pursuant to that policy, PD No. 1468 requires the Philippine Coconut Authority ("PCA") to, among others, formulate and implement a nationwide replanting program using precocious high-yielding hybrid seednuts, which program may include the planting of new areas; WHEREAS, the PCA has formulated a nationwide coconut replanting program and has recommended the inclusion in said program of the planting of hybrid coconut in sizable, contiguous new areas; WHEREAS, the PCA has identified that among the new areas suitable for the planting of the hybrid seednuts are the logged-over, denuded and inadequately stocked forest lands, particularly in the Agusan...
