EXECUTIVE ORDER NO. 813Establishing the System of Position Classification and Compensation for the Office of the Prime Minister (Proper) as well as the Rules and Regulations for its Implementation
• The system consists of the Position Classification Plan and the Compensation Plan for the Office of the Prime Minister (Proper). (Sec. 1)
• It covers all regular positions in the Office of the Prime Minister (Proper), except the positions of the Prime Minister and Deputy Prime Minister. (Sec. 2)
Position Classification Plan:
• Positions are divided into two main categories: Career Executive Service Level and Sub-Career Executive Service Level. (Sec. 3)
• Career Executive Service Level positions and their corresponding ranks are listed. (Sec. 4)
• The Secretary-General position has a compensation equal to two-grades higher than Rank I positions. (Sec. 4)
• Sub-Career Executive Service Level positions and their corresponding pay ranges are listed. (Sec. 4)
Compensation Plan:
• The salary scale of the Career Executive Service applies to CES level positions in the Office of the Prime Minister, with a one-grade advantage over comparable positions in the CES Compensation Plan. (Sec. 5)
• The salary scale for the Sub-Career Executive Service Level is provided. (Sec. 5)
Classification Rules:
• Positions must be classified by the Office of Budget and Management before inclusion in the regular or special budgets. (Sec. 6a)
• Positions are classified based on regular and permanent duties, responsibilities, and qualification requirements. (Sec. 6b)
• Proposals for new positions must follow Presidential Decree Nos. 985 and 1177. (Sec. 6c)
• Reclassification of a position may be proposed when there are significant and permanent changes in duties and responsibilities. (Sec. 6d)
• The effective date of classification or reclassification is specified. (Sec. 6e)
• The classification plan applies to all existing and future positions in the Office of the Prime Minister. (Sec. 6f)
Salary Rules:
• The hiring rate for new employees follows existing OBM Circulars and Memoranda. (Sec. 7a)
• An employee may be allowed a higher salary rate if they previously received a higher salary in the government service, within the pay range allocation of the position and with sufficient appropriation. (Sec. 7b)
• An employee promoted to a higher position may continue to receive their present salary if it is over the maximum rate of the new position's pay range. (Sec. 7c)
• Upon certification of satisfactory service, an employee's salary may be increased to the next higher step after one year, with sufficient appropriation. (Sec. 7d)
• Employees with salaries between steps of their pay range may be entitled to adjustment to the next higher step, if appropriation is provided. (Sec. 7e)
• Voluntary demotion may be made without loss of salary, except when the current salary is higher than the maximum of the demoted class, and with sufficient appropriation. (Sec. 7f)
• No employee shall receive a higher salary than their immediate supervisor. (Sec. 7g)
Salary Increases:
• Employees paid from lump-sum appropriations may be granted salary increases upon recommendation of the Minister of Budget and approval of the Prime Minister, charged against the respective lump-sum appropriations. (Sec. 8)
• Whenever a national government salary increase is allowed based on a periodic nation-wide salary survey, positions in the Office may be granted across-the-board or in-step increases, upon recommendation of the Minister of the Budget and approval of the President. (Sec. 9)
• If the salary survey requires revision of the Classification and Compensation Plans, they may be revised upon recommendation of the Minister of the Budget and Prime Minister, and approval of the President. (Sec. 10)
Additional Compensation:
• Transportation and representation allowances are granted only to specified officials and those of equivalent rank, as determined by the Office of Budget and Management. (Sec. 11a)
• Employees are entitled to cost of living allowances for national government employees, subject to availability of funds. (Sec. 11b)
• All regular employees are granted uniform/clothing allowances at the rates authorized in the Appropriations Act, charged against savings or "other services" appropriations. (Sec. 11c)
• Regular employees are entitled to per diems in accordance with Section 79, Presidential Decree No. 1177. (Sec. 11d)
• The maximum amount for each type of allowance is determined in accordance with the approved Personal Services Itemization. (Sec. 11e)
Other Provisions:
• The compensation and position classification plans for the Office of the Prime Minister are established within the context of Presidential Decree No. 985 and shall not be changed without the approval of the President upon recommendation of the Minister of the Budget. (Sec. 12)
• P500,000 is appropriated from the National Treasury to cover the difference between the authorized and actual salary of OP personnel transferred to the OPM pursuant to Executive Order No. 708. (Sec. 13)
• Any inconsistent laws, executive orders, rules and regulations are repealed or modified accordingly. (Sec. 14)
• The Order takes effect on April 1, 1982. (Sec. 15)

WHEREAS, pursuant to the 1981 Amendments to the Constitution, the Office of the Prime Minister was created under Executive Order No. 708 dated July 27, 1981;
WHEREAS, the Prime Minister is the head of the Cabinet and the Chairman of the Executive Committee, as well as, responsible for the day-to-day supervision of all ministries and the details of administration of the government pursuant to the provisions of the Constitution and the aforementioned Executive Order;
WHEREAS, in view of the transfer of personnel from the Office of the President to the Office of the Prime Minister under Executive Order No. 708 and the need to adopt a comparable position classification and compensation schemes for the purpose; and
WHEREAS, the constitutional responsibilities of the Prime Minister require an effective, responsive and efficient organizational structure and staff;
