Amending Presidential Decree No. 9 to Impose the Mandatory Death Penalty

- Imposes the mandatory penalty of death for the following offenses (Section 1, Paragraph 5):
    - Using an unlicensed firearm or deadly weapon in committing terroristic activities related to subversion, rebellion, insurrection, or sedition.
    - Attempting on the life of the President/Prime Minister, Cabinet members, members of the Interim Batasang Pambansa, high-ranking military officers (Brigadier General or equivalent), Supreme Court Justices, Constitutional Commission members, or their immediate family members using an unlicensed firearm or deadly weapon.
    - Using an unlicensed firearm or deadly weapon against the aforementioned government officials or their immediate family members during the commission of subversion, rebellion, insurrection, or sedition.

- Defines "deadly weapon" as any firearm, weapon or instrumentality, not including a blunt instrument, which in the manner it is used or intended to be used is likely to produce death or great bodily harm (Section 1, Paragraphs 2 and 3).

- Cites the maintenance of peace, order, and government stability as reasons for the decree (Preamble).

- Recognizes the threat posed by the use of illegal firearms, explosives, and deadly weapons in furtherance of subversion, rebellion, insurrection, lawless violence, and public disorder (Preamble).

- Acknowledges the recent bombings, acts of terrorism, and lawlessness committed by radicals and criminal elements, resulting in civilian casualties, property damage, disruption of activities, and public fear or panic (Preamble).

- Declares the urgent necessity to amend Presidential Decree No. 9 to provide an effective deterrent to the use of firearms and deadly weapons in certain offenses by imposing capital punishment (Preamble).

- Mandates the immediate effect of the decree (Section 2).

MALACAÑANGM a n i l a PRESIDENTIAL DECREE No. 1811 FURTHER AMENDING PRESIDENTIAL DECREE NO. 9, AS AMENDED BY PRESIDENTIAL DECREE NO. 1728 WHEREAS, the maintenance of peace and order and the stability of the government depends greatly on the security of the lives of our national leaders; WHEREAS, the use of illegal firearms, explosives and other deadly weapons as means for the commission and/or furtherance of subversion, rebellion, insurrection, lawless violence and widespread public disorder greatly imperils the existence and survival of the State; WHEREAS, in view of the recent bombings and other acts of terrorism and lawlessness committed or being carried out by radicals and criminal elements, resulting in death and serious injuries to innocent civilians, damage to property, disruption of normal activities, and fear or panic among the populace, there is an urgent necessity to amend Presidential Decree No. 9, to provide an effective deterrent to the use of firearms and deadly weapons in the commission of certain offenses by providing capital punishment therefor; NOW, THEREFORE, I, FERDINAND E.
