FURTHER AMENDING SECTION 12 OF ACT NO. 2613, AS AMENDED, ENTITLED "AN ACT TO IMPROVE THE METHODS OF PRODUCTION AND THE QUALITY OF TOBACCO IN THE PHILIPPINES AND TO DEVELOP THE EXPORT TRADE THEREIN"
WHEREAS, all the vital segments of the tobacco industry should be represented in the Philippines Tobacco Board;
WHEREAS, there is a pressing need to promote and serve the interests of tobacco planters, tobacco exporters and importers, cigar and cigarette manufacturers and others concerned; and
WHEREAS, it is necessary that the Philippine Tobacco Board as presently constituted under Act No. 2613, as amended, be reorganized as the sole policy-making body of the tobacco industry;

Presidential Decree No. 355
This Presidential Decree amends Section 12 of Act No. 2613, which governs the tobacco industry in the Philippines. The key provisions are:
Allocation of Tobacco Inspection Fees (Section 12):
- 50% of inspection fees collected from leaf tobacco, tobacco products, and imports shall accrue to the Cultural Center of the Philippines.
- Remaining 50% shall accrue to the 'Tobacco Inspection Fund'.
Tobacco Inspection Fund (Section 12):
- Administered by a Board consisting of:
- Commissioner of Internal Revenue (ex officio Chairman)
- Director of Plant Industry (ex officio member)
- Director of Foreign Trade (ex officio member)
- General Manager of Philippine Virginia Tobacco Administration (ex officio member)
- One member representing tobacco exporters (appointed by the President for 4 years)
- One member representing cigar and cigarette manufacturers (appointed by the President for 4 years)
- One member representing Virginia and other aromatic tobacco planters (appointed by the President for 4 years)
- One member representing native type tobacco planters (appointed by the President for 4 years)
- The Board shall have a Secretary elected by its members and compensated at a rate determined by the Board with the approval of the Secretary of Finance.
Purposes of the Tobacco Inspection Fund (Section 12):
- Payment of salaries and expenses for the Tobacco Inspection Service Division under the Office of the Commissioner of Internal Revenue.
- Payment of salaries for the staff of the Philippine Tobacco Board.
- Advertising and promotion of Philippine tobacco and tobacco products in domestic and foreign markets.
- Improvement of tobacco culture and production (30% of the Fund shall be expended for this purpose).
- Other necessary expenses as determined by the Philippine Tobacco Board.
