Case Overview and Summary
Declaration of PolicySection 1: The State shall ensure that economic development is achieved without delay and consistent with sustainable development principles, meeting the needs of the present generation without compromising the ability of future generations to meet their own needs.
Simultaneous Conduct of Environmental Impact Study and Feasibility Study
Section 2: Project proponents are directed to simultaneously conduct the environmental impact study and feasibility study of the proposed project, using it as a planning tool to minimize or manage adverse environmental impacts.
Establishment of In-house Environmental Units
- Section 3: National government agencies, government-owned and controlled corporations (GOCCs), and government financial institutions (GFIs) are encouraged to create environmental units (EUs).
- Agencies whose mandate includes introducing physical plants and infrastructure are required to create EUs.
- The costs shall be within the approved budgetary ceilings of the concerned agencies.
- Functions of EUs:
i. For agencies and GOCCs: Assist in EIS preparation, ensure procedural compliance, facilitate securing ECCs, and ensure compliance with ECC conditions. (Section 3i)
ii. For GFIs: Ensure loan or funding applications have complied with the EIS System. (Section 3ii)
- DENR and EMB shall monitor ECC compliance, formulate policies on environmental standards, and enforce compliance monitoring.
Continuous Strengthening of Environmental Impact Assessment Capability
Section 4: Efforts shall be made to upgrade DENR-EMB's and DENR Regional Offices' capabilities for fast and efficient EIS review, including expanding the EIA Review Committee members and setting their honoraria within DBM limits and qualifications.
Repealing Clause
Section 5: All orders, issuances, circulars, rules, and regulations inconsistent with this Executive Order are repealed or amended.
Effectivity
Section 6: This Order shall take effect immediately.

IMPROVING THE ENVIRONMENTAL IMPACT STATEMENT SYSTEM
WHEREAS, the Environmental Impact Statement (EIS) System was established to facilitate the attainment and maintenance of a rational and orderly balance between socio-economic growth and environmental protection;
WHEREAS, the integration of the EIS System early into the project development cycle would enhance and promote its desired function as a planning tool for sustainable economic development and environmental planning and conservation;
WHEREAS, it is necessary to further strengthen the Environmental Management Bureau's and the DENR Regional Office's capabilities to effectively and efficiently accomplish their mandate in relation to the protection of the environment, in general, and the EIS System, in particular;
WHEREAS, the continued updating and improvement of the Philippine EIS System is vital to expedite the National Government's efforts to make the delivery of vital infrastructure to the country faster and be consistent with the principles of sustainable development;
WHEREAS, a systematic and cohesive EIS System shall ensure that national development goals are achieved as planned and without delay;
