Case Overview and Summary

Lifting the Suspension of the Privilege of Habeas Corpus Throughout the Philippines

- The privilege of the writ of habeas corpus was previously suspended throughout the Philippines under Proclamation No. 210 dated October 22, 1950, for crimes related to sedition, insurrection, rebellion, and offenses committed in connection with these crimes.
- The suspension was lifted in some provinces where peace and order had improved sufficiently.
- The dangers to national security and disturbances to public order and safety that necessitated the suspension have been minimized or eliminated, as attested by the Chief of Staff of the Armed Forces of the Philippines.
- President Elpidio Quirino, by virtue of the powers vested in him by law, lifts the suspension of the privilege of the writ of habeas corpus in all provinces and cities of the Philippines where the suspension had not been previously lifted.
- Proclamation No. 210 dated October 22, 1950, is hereby revoked.
- The proclamation was issued in the City of Manila on November 24, 1953, in the eighth year of Philippine independence.
