PRESIDENTIAL DECREE No. 1434

MERGING THE ISABELA STATE COLLEGE OF AGRICULTURE AND CAGAYAN VALLEY INSTITUTE OD TECHNOLOGY INTO A STATE UNIVERSITY TO BE KNOWN AS THE ISABELA STATE UNIVERSITY, TRANSFERRING THE COLLEGE LEVEL COURSES OF ISABELA SCHOOL OF ARTS AND TRADES, JONES RURAL SCHOOL, ROXAS MEMORIAL AGRICULTURAL AND INDUSTRIAL SCHOOL, AND SAN MATEO VOCATIONAL AND INDUSTRIAL SCHOOL INTO SAID UNIVERSITY, PROVIDING A CHARTER FOR THIS PURPOSE, AND APPROPRIATE FUNDS THEREFOR

WHEREAS, the Constitution of the Philippines directs the State to establish and maintain a complete, adequate and integrated system of education relevant to the goals of national development and further prescribes that all educational institutions shall aim to develop scientific, technological, and vocational efficiency;

WHEREAS, under Presidential Decree No. 6-A also known as the Educational Decree of 1972 promulgated on September 20, 1972, it has been declared a policy of the government to re-orient the educational system toward the accelerated national economic growth and meaningful social development;

Summary of Presidential Decree No. 1434

Establishment of Isabela State University
- Merges Isabela State College of Agriculture and Cagayan Valley Institute of Technology into Isabela State University (Section 1)
- Transfers college-level courses from Isabela School of Arts and Trades, Jones Rural School, Roxas Memorial Agricultural and Industrial School, and San Mateo Vocational and Industrial School into the University (Section 1)
- Main campus and administrative site at Echague, Isabela (Section 1)

Purpose and Functions
- Provide advanced instruction in arts, agricultural and natural sciences, technology, and professional fields (Section 2)

Board of Regents
- Governing body composed of:
    - Secretary of Education and Culture as Chairman (Section 3)
    - University President as Vice Chairman (Section 3)
    - Representative from National Economic Development Authority (Section 3)
    - Six prominent citizens appointed by the President of the Philippines (Section 3)
- Quorum is majority of all members (Section 4)
- Members are not compensated but reimbursed for expenses (Section 5)
- Powers and duties include:
    - Prescribe rules and regulations (Section 6a)
    - Receive and appropriate funds (Section 6b)
    - Receive and administer legacies, gifts, and donations (Section 6c)
    - Approve curricula and rules of discipline (Section 6d)
    - Confer degrees, award honorary degrees, and authorize certificates (Section 6e)
    - Appoint officials and employees, fix compensation and duties (Section 6f)
    - Establish chairs and provide fellowships and scholarships (Section 6g)
    - Fix tuition fees and other charges (Section 6h)
    - Authorize construction and repair of facilities (Section 6i)

Non-Discrimination Policy
- No student shall be denied admission based on sex, nationality, religion, or political belief (Section 7)

University President
- Head of the University (Section 8)
- Appointed by the President of the Philippines for 6 years (Section 8)
- Powers and duties pertaining to the office (Section 8)

Administrative Council
- Composed of University President as Chairman, Vice-Presidents, and Provosts (Section 10)
- Prepares and promulgates policies on personnel, financial management, and development planning (Section 10)

College Council
- Exists in each college or unit with Provost as Chairman and faculty as members (Section 11)
- Powers include:
    - Prescribe curricula and rules of discipline (Section 11)
    - Fix admission and graduation requirements (Section 11)
    - Recommend degree recipients (Section 11)
    - Exercise disciplinary power over students (Section 11)

Faculty
- Exempt from civil service examination or regulation (Section 12)
- No religious test or inquiry for appointment (Section 12)
- Cannot teach for or against any particular church or sect (Section 12)

Advisory Council
- Exists for each college or unit, headed by the Provost (Section 13)
- Provides advice and counsel to Provosts on general policy matters (Section 13)
- Initial members are current Board of Regents or Trustees members, except the Chairman (Section 13)
- Subsequent members appointed by Board of Regents (Section 13)

Finances and Auditing
- Treasurer of the Philippines is ex-officio treasurer of the University (Section 14)
- Accounts and expenses audited by Commission on Audit (Section 14)

Transfer of Resources
- Personnel, assets, records, and appropriations of merged institutions transferred to the University (Section 15)
- Appropriations of transferred vocational schools not included (Section 15)

Support from Government Agencies
- Heads of government bureaus and offices in Region II authorized to loan or transfer equipment, supplies, and detail employees to the University (Section 16)

Implementation and Reporting
- Secretary of Education and Culture directed to implement the Decree (Section 17)
- Authorized to create a technical committee to advise the Board of Regents (Section 17)
- Board of Regents to file annual report with the Office of the President (Section 18)

Funding
- One Million Pesos (₱1,000,000) appropriated to carry out the Decree (Section 19)
- Subsequent funding included in the Annual Appropriation Act (Section 19)

Repealing Clause
- Republic Act Nos. 6507 and 3442, and other contrary laws, acts, decrees, or executive orders are repealed or amended (Section 20)

Effectivity
- The Decree takes effect immediately (Section 21)
