Case Overview and Summary

Modifying the Nomenclature and Rates of Import Duty on Certain Imported Articles

• Pursuant to Sections 104 and 401 of the Tariff and Customs Code of 1978, the President is empowered to modify import duty rates and forms of duty.

Rates of Import Duty on Certain Articles (Section 1):
- Aluminium bars, rods and profiles under Heading 76.04:
    • Y-shape profiles for zippers, in coils (7604.29.10): 3% from 1997 to 2000 (Section 1)
    • Other (7604.29.90): 20% in 1997, 10% from 1998 to 2000 (Section 1)
- Aluminium wire under Heading 76.05:
    • Of aluminium, not alloyed, with maximum cross-sectional dimension exceeding 7 mm (7605.11.00): 10% in 1997, 3% from 1998 to 2000 (Section 1)
- Other articles of aluminium under Heading 76.16:
    • Tube for yarn winders; Bobbins, spools and similar supports for textile yarn (7616.99.40): 3% from 1997 to 2000 (Section 1)
- Prepared unrecorded media for sound recording under Heading 85.23:
    • Compact discs (CD) media (8523.90.10): 3% from 1997 to 2000 (Section 1)
    • Other (8523.90.90): 20% from 1997 to 2000 (Section 1)

Other Provisions:
- Tariff headings not enumerated and those represented by "x x x" shall remain in force and effect (Section 2).
- The prescribed duty rates shall apply to articles entered or withdrawn from warehouses in the Philippines for consumption upon the effectivity of this Executive Order (Section 3).
- Inconsistent presidential issuances, administrative rules and regulations are revoked or modified accordingly (Section 4).
- This Executive Order shall take effect thirty (30) days following its complete publication in two (2) newspapers of general circulation in the Philippines (Section 5).

EXECUTIVE ORDER NO. 390 MODIFYING THE NOMENCLATURE AND RATES OF IMPORT DUTY ON CERTAIN IMPORTED ARTICLES UNDER SECTION 104 OF THE TARIFF AND CUSTOMS CODE OF 1978 (PRESIDENTIAL DECREE NO. 1464), AS AMENDED WHEREAS, Sections 104 and 401 of the Tariff and Customs Code of 1978 (Presidential Decree No. 1464), as amended, empower the President, upon the recommendation of the National Economic and Development Authority, to increase, reduce or remove existing protective rates of import duty, as well as to modify the form of duty. NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order: Section 1. The following articles under Section 104 of the Tariff and Customs Code, as amended, shall have rates of import duty in accordance with the schedule indicated opposite each article as listed below: HDG NO.
