EXECUTIVE ORDER NO. 336 May 16, 1996

MODIFYING THE RATES OF DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE DECISION TAKEN BY THE ASEAN SENIOR ECONOMIC OFFICIAL'S MEETING TO EXTEND A MINIMUM 50% MARGIN OF PREFERENCE ON CERTAIN PRODUCTS INCLUDED IN THE BRAND-TO-BRAND COMPLEMENTATION SCHEME IN THE AUTOMOTIVE INDUSTRY UNDER THE BASIC AGREEMENT ON ASEAN INDUSTRIAL COMPLEMENTATION

WHEREAS, the Philippines is a Contracting Party to the Basic Agreement on ASEAN Industrial Complementation (BAAIC) signed in Manila on 18 June 1981;

WHEREAS, the Philippines is a signatory to the Memorandum of Understanding (MOU) on the Brand-to-Brand Complementation (BBC) Scheme for the Automotive Industry under the BAAIC signed by the ASEAN Economics Ministers in Pattaya, Thailand on 18 October 1988;

WHEREAS, the Philippines, along with Malaysia and Thailand, is a participating country in the approved BBC Scheme of Nissan Motor Co., Ltd.;

Summary of Executive Order No. 336

Granting 50% Margin of Preference (MOP) for Certain Automotive Products under the Nissan Brand-to-Brand Complementation (BBC) Scheme

- Background: The Philippines is a party to the ASEAN Basic Agreement on Industrial Complementation and the Memorandum of Understanding on the BBC Scheme for the Automotive Industry. (Preamble)
- The Philippines, Malaysia, and Thailand are participating countries in the approved Nissan BBC Scheme. (Preamble)
- Certain component parts for Nissan Sentra and Nissan AD Resort vehicles, specified in Certificates of Eligibility, are existing BBC products approved by ASEAN Senior Economic Officials' Meeting (SEOM) in March 1995. (Preamble)

Provisions:

- Articles listed in Annex "A" shall be accorded a minimum 50% MOP, subject to the specified BBC Preferential Tariff rates. (Section 1)
- The 50% MOP for certain parts for Nissan Sentra and AD Resort from Thailand shall be exclusive until June 14, 1999, and may be extended up to June 13, 2003, if non-participating ASEAN countries do not grant the same MOP. (Section 2)
- The 50% MOP for certain parts for Nissan Sentra and AD Resort from Malaysia shall be exclusive until June 14, 1999, and may be extended up to June 13, 2003, if non-participating ASEAN countries do not grant the same MOP. (Section 3)
- Effective June 14, 2003, the 50% MOP shall be extended to any entity in another ASEAN member country producing the subject BBC products, regardless of participation in the BBC Scheme. (Section 4)
- The 50% MOP shall remain effective regardless of any subsequent changes in the basic Philippine rate of duty. (Section 5)
- The articles shall be subject to qualification under the Rules of Origin prescribed in the ASEAN Preferential Trading Arrangements and shall pay the applicable BBC Preferential Tariff. (Section 6)
- The Department of Trade and Industry shall communicate any revisions to the part numbers in Annex "A" to the Bureau of Customs within 5 days of receiving the revised part numbers from the ASEAN Secretariat. (Section 7)
- The Executive Order shall take effect immediately. (Section 8)
