- Amends the tariff rates under Tariff Heading Nos. 56.01 and 56.02 of the Tariff and Customs Code of 1978 (Presidential Decree No. 1464) for the following articles:
• Regenerated fibres (including rayon), ad val. (Sec. 1)
    - 10% duty rate effective July 1, 1985 to December 31, 1987
    - 20% duty rate effective January 1, 1988
• Continuous filament tow for the manufacture of man-made fibres (discontinuous) of regenerated fibres (including rayon) (Sec. 1)
    - 10% duty rate effective July 1, 1985 to December 31, 1987
    - 20% duty rate effective January 1, 1988
- Aims to maintain the 1984 tariff rate of 10% for rayon to enable the textile industry to be competitive in the world market (Preamble)
- Cites the powers vested in the President by the Constitution and Section 401 of the Tariff and Customs Code as legal basis (Preamble)
- Took effect immediately upon issuance on July 9, 1985 (Sec. 2)

EXECUTIVE ORDER NO. 1038 July 9, 1985 MODIFYING THE RATES OF DUTY ON IMPORTED RAYON ARTICLES AS PROVIDED UNDER PRESIDENTIAL DECREE NO. 1464, AS AMENDED, OTHERWISE KNOWN AS THE TARIFF AND CUSTOMS CODE OF 1978 WHEREAS, Executive Order No. 926 provided that effective January 1, 1985, the tariff duty for regenerated fibres (including rayon) shall be increased to 20%; WHEREAS, there has been a delay in the implementation of the rayon project and local textile mills have to import raw materials for, their requirements; WHEREAS, there is a need to maintain the 1984 tariff rate of 10% for rayon to enable the textile industry to be competitive in the world market; NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution, and Section 401 of the Tariff and Customs Code, as amended, do hereby order and direct: Sec. 1.
