EXECUTIVE ORDER No. 448 July 22, 2005
MODIFYING THE RATES OF IMPORT DUTY OF CERTAIN ARTICLES UNDER THE TARIFF AND CUSTOMS CODE OF 1978 (PRESIDENTIAL DECREE NO. 1464, AS AMENDED), IN ORDER TO IMPLEMENT THE ASEAN INTEGRATION SYSTEM OF PREFERENCES (AISP) PACKAGE OF THE PHILIPPINES
WHEREAS, at the 4th ASEAN Informal Summit held in Singapore in November 2000, the ASEAN Heads of Government/State agreed on the Initiative for ASEAN Integration (IAI) in order to narrow the development gap between the older and newer members of ASEAN and to enhance the new members integration with the rest of the ASEAN;
WHEREAS, to implement the decision of the ASEAN Heads of Government/State, the ASEAN Economic Ministers (AEM), at their meeting in Siemrap, Cambodia on 3-5 May 2001, decided to implement the ASEAN GSP Scheme (now AISP) on a bilateral basis;

Modifying Import Duty Rates to Implement ASEAN Integration System of Preferences (AISP)
- Background:
    - ASEAN Heads of Government agreed on Initiative for ASEAN Integration (IAI) to narrow development gap between older and newer ASEAN members (Section 1)
    - ASEAN Economic Ministers decided to implement ASEAN GSP Scheme (now AISP) on bilateral basis (Section 2)
    - Preference given by Brunei, Indonesia, Malaysia, Philippines, Singapore and Thailand to Cambodia, Lao PDR, Myanmar and Vietnam (Section 3)
- Provisions:
    - Articles listed in "Annex A" imported from Cambodia, Lao PDR, Myanmar and Vietnam shall be subject to AISP duty rate in Column 4 of Annex A (Section 1)
    - If basic Philippine duty rate on any article in Annex A is reduced below AISP rate, the lower rate shall apply (Section 2)
    - Articles in Annex A must meet 40% single country content rule of origin from Cambodia, Lao PDR, Myanmar and Vietnam (Section 3)
    - Contrary issuances are repealed or modified (Section 4)
    - Effective immediately after publication in two newspapers of general circulation (Section 5)
- Legal Basis:
    - Section 402 of Tariff and Customs Code of 1978 empowers the President to modify import duty rates (Section 4)
