EXECUTIVE ORDER NO. 325 April 1, 1988

MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE DECISIONS OF THE THIRD ASEAN SUMMIT AND THE TWENTY THIRD MEETING OF THE COMMITTEE ON TRADE AND TOURISM (COTT) TO PROVIDE A MINIMUM LEVEL OF 25% MARGIN OF PREFERENCE TO CERTAIN ITEMS WHICH ARE CONTAINED IN THE PHILIPPINE EXCLUSION LIST AND TO DEEPEN THE MARGIN OF PREFERENCE IN RESPECT OF CERTAIN ITEMS WHICH ARE UNDER THE ASEAN PREFERENTIAL TRADING ARRANGEMENTS (PTA) TO 50% WITHIN FIVE YEARS.

Pursuant to the powers vested in me under Section 402 of the Tariff and Customs Code of 1978, as amended, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:

Sec. 1. The Articles specifically listed in Annex "A" hereof as classified under Section 104 of the Tariff and Customs Code of 1978, as amended, shall be accorded a minimum level of 25% Margin of Preference (MOP) as items being...

Modifying Import Duty Rates to Implement ASEAN Agreements

- Provides a minimum 25% Margin of Preference (MOP) for items listed in Annex "A" introduced into ASEAN Preferential Trading Arrangements (PTA) from the Philippine Exclusion List (Section 1)
• These items shall be subject to the Preferential Tariff for ASEAN as per the schedule in Annex "A", Column 5

- Deepens the MOP to 50% within 5 years for items listed in Annex "B" under the ASEAN PTA (Section 1)
• These items shall be subject to the Preferential Tariff for ASEAN as per the schedules in Annex "B", Columns 5, 7, 9, 11, and 13

- Any subsequent changes to the basic Philippine duty rate on these articles shall automatically be accorded the corresponding MOP (Section 2)

- Articles entered or withdrawn from warehouse in the Philippines for consumption after the effective date shall be subject to the prescribed import duty rate, subject to qualification under the Rules of Origin specified in the ASEAN PTA Agreement ratified on August 1, 1977 (Section 3)

- Effective date: April 1, 1988 (Section 4)
