MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE DECISIONS OF THE THIRD ASEAN SUMMIT AND THE TWENTY-FOURTH MEETING OF THE COMMITTEE ON TRADE AND TOURISM (COTT) TO PROVIDE A MINIMUM LEVEL OF 25% MARGIN OF PREFERENCE TO CERTAIN ITEMS WHICH ARE CONTAINED IN THE PHILIPPINE EXCLUSION LIST AND TO DEEPEN THE MARGIN OF PREFERENCE IN RESPECT OF CERTAIN ITEMS WHICH ARE UNDER THE ASEAN PREFERENTIAL TRADING ARRANGEMENTS (PTA) TO 50% WITHIN FIVE YEARS
Pursuant to the powers vested in me under Section 402 of the Tariff and Custom Code of 1978, as amended, I, Corazon C. Aquino, President of the Philippines, do hereby order: SECTION 1. Modifying the Rates of Import Duty on Certain Imported Articles
- Provides a minimum level of 25% Margin of Preference (MOP) for certain items introduced into the ASEAN Preferential Trading Arrangements (PTA) from the Philippine Exclusion List (Section 1)
• These items are listed in Annex "A" and shall be subject to the Preferential Tariff for ASEAN as per the schedule in Column 5 of Annex "A".
- Deepens the Margin of Preference to 50% within five years for certain items under the ASEAN PTA (Section 1)
• These items are listed in Annex "B" and shall be subject to the Preferential Tariff for ASEAN as per the schedules in Columns 5, 7, 9, 11, and 13 of Annex "B".
- In case of any subsequent changes in the basic Philippine rate of duty on the mentioned articles, they shall automatically be accorded the corresponding margin of preference (Section 2).
- After the effectivity date, all the described articles entered or withdrawn from warehouses in the Philippines for consumption shall be subject to the prescribed rate of import duty, subject to qualification under the Rules of Origin specified in the Agreement on ASEAN Preferential Trading Agreements ratified on August 1, 1977 (Section 3).
- The Executive Order took effect on January 1, 1989 (Section 4).
