Modifying the Rates of Import Duty on Certain Imported Articles

- Pursuant to Section 401 of Republic Act No. 1937 (Tariff and Customs Code of the Philippines), the following import duty rates are prescribed: (Sec. 1)
• Carbon black: P0.50 per net kilogram or 50% ad valorem
• Other pure carbon: 15% ad valorem

- The prescribed import duty rates shall apply to articles entered or withdrawn from warehouses in the Philippines for consumption after 30 days from the issuance of this Order. (Sec. 2)

- Unwarranted increase in prices of local products benefited by these tariff changes may be grounds for revocation of such tariff changes. (Sec. 3)

EXECUTIVE ORDER NO. 369 January 21, 1972 MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED UNDER REPUBLIC ACT NUMBERED NINETEEN HUNDRED THIRTY-SEVEN, OTHERWISE KNOWN AS THE TARIFF AND CUSTOMS CODE OF THE PHILIPPINES, AS AMENDED Pursuant to the powers vested in me by Section 401 of Republic Act Numbered Nineteen Hundred Thirty-Seven, I, FERDINAND E. MARCOS, President of the Philippines, do hereby direct and order: Sec. 1. The articles specifically listed hereunder as classified under Section 104 of Republic Act Numbered Nineteen Hundred Thirty-Seven shall pay the following rates of import duty: Tariff Heading No. Description of Article Rate of Duty 28.03 Carbon, pure (e.g. carbon black anthracene black, acetylene black): A. Carbon black n.w. kg. P0.50 or ad val. 50% B. Other ad val. 15% Sec. 2. After the expiration of thirty (30) days from the issuance of this Order, all the above-described articles entered or withdrawn from warehouses, in the Philippines, for consumption shall be subject to the rates of import duty herein prescribed.
