Summary of Presidential Decree No. 1829

Penalizing Obstruction of Apprehension and Prosecution of Criminal Offenders

- Imposes penalties for acts that obstruct or frustrate the apprehension and prosecution of criminal offenders:

• Preventing witnesses from testifying or reporting crimes through bribery, misrepresentation, deceit, intimidation, force or threats. (Section 1a)
• Altering, destroying, suppressing or concealing evidence with intent to impair its admissibility. (Section 1b)
• Harboring or facilitating the escape of a known offender to prevent arrest, prosecution or conviction. (Section 1c)
• Using a fictitious name to conceal a crime, evade prosecution or judgment, or conceal true identity for the same purposes. (Section 1d)
• Delaying prosecution by obstructing service of process, court orders or disturbing proceedings. (Section 1e)
• Presenting false evidence with intent to affect the course or outcome of criminal proceedings. (Section 1f)
• Soliciting or accepting benefits in exchange for impeding the prosecution of an offender. (Section 1g)
• Threatening another to prevent them from appearing in criminal proceedings or imposing conditions for their appearance. (Section 1h)
• Giving false or fabricated information to mislead law enforcement or prevent apprehension of offenders or protection of victims, or fabricating and publishing confidential investigation data. (Section 1i)

- Penalties: Prision correccional in its maximum period (6 years and 1 day to 6 years), or a fine ranging from 1,000 to 6,000 pesos, or both. (Section 1)
- If penalized by another law with a higher penalty, the higher penalty shall be imposed. (Section 1)
- If committed by a public official or employee, they shall suffer perpetual disqualification from holding public office in addition to the penalties. (Section 2)
- Took effect immediately upon issuance on January 16, 1981. (Section 3)

MALACAÑANG M a n i l a PRESIDENTIAL DECREE No. 1829 PENALIZING OBSTRUCTION OF APPREHENSION AND PROSECUTION OF CRIMINAL OFFENDERS WHEREAS, crime and violence continue to proliferate despite the sustained vigorous efforts of the government to effectively contain them; WHEREAS, to discourage public indifference or apathy towards the apprehension and prosecution of criminal offenders, it is necessary to penalize acts which obstruct or frustrate or tend to obstruct or frustrate the successful apprehension and prosecution of criminal offenders; NOW, THEREFORE, I, FERDINAND, E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law do hereby decree and order the following: Section 1. The penalty of prision correccional in its maximum period, or a fine ranging from 1,000 to 6,000 pesos, or both, shall be imposed upon any person who knowingly or willfully obstructs, impedes, frustrates or delays the apprehension of suspects and the investigation and prosecution of criminal cases by committing any of the following acts: (a) preventing witnesses from testifying in any criminal proceeding or from reporting the commission...
