Case Overview and Summary
PHILIPPINE ENVIRONMENTAL POLICYPolicy and Goal (Sections 1 and 2):
- The State's continuing policy is to:
• Create, develop, maintain, and improve conditions for harmonious coexistence of man and nature.
• Fulfill social, economic, and other requirements of present and future generations.
• Ensure environmental quality conducive to a life of dignity and well-being.
- The Government's responsibility, in cooperation with private entities, is to:
• Recognize and fulfill responsibilities as trustee and guardian of the environment for future generations. (Section 2a)
• Assure a safe, decent, healthful, productive, and aesthetic environment. (Section 2b)
• Encourage exploitation of the environment without degrading it or endangering human life, health, safety, or creating adverse conditions for agriculture, commerce, and industry. (Section 2c)
• Preserve important historic and cultural aspects of Philippine heritage. (Section 2d)
• Attain a rational and orderly balance between population and resource use. (Section 2e)
• Improve utilization of renewable and non-renewable resources. (Section 2f)
Right to a Healthy Environment (Section 3):
- The Government recognizes the people's right to a healthful environment.
- It is the duty and responsibility of each individual to contribute to preserving and enhancing the Philippine environment.
Environmental Impact Statements (Section 4):
- All government agencies, government-owned or controlled corporations, and private corporations, firms, and entities shall prepare, file, and include a detailed environmental impact statement for any action, project, or undertaking that significantly affects the environment. The statement should cover:
• Environmental impact of the proposed action, project, or undertaking. (Section 4a)
• Any adverse environmental effect that cannot be avoided if implemented. (Section 4b)
• Alternatives to the proposed action. (Section 4c)
• Determination that short-term uses of environmental resources are consistent with maintaining and enhancing long-term productivity. (Section 4d)
• Finding that the use and commitment of depletable or non-renewable resources are warranted, if applicable. (Section 4e)
- Before issuing an environmental impact statement, all agencies with jurisdiction or special expertise on the subject matter shall comment on the draft statement within thirty (30) days of receipt.
Agency Guidelines (Section 5):
- Agencies charged with environmental protection, as enumerated in Letter of Instruction No. 422, shall submit their respective guidelines, rules, and regulations to carry out the provisions on environmental impact assessments and statements to the National Environmental Protection Council (NEPC) within sixty (60) days from the effectivity of this Decree.
Repealing Clause (Section 6):
- All Acts, Presidential Decrees, executive orders, rules, and regulations or parts thereof inconsistent with this Decree are repealed, amended, or modified accordingly.
Effectivity (Section 7):
- This Decree shall take effect immediately.

PRESIDENTIAL DECREE No. 1151
PHILIPPINE ENVIRONMENTAL POLICY
WHEREAS, the individual and, at times, conflicting, demands of population growth, urbanization, industrial expansion, rapid natural resources utilization and increasing technological advances have resulted in a piecemeal-approach concept of environmental protection;
WHEREAS, such tunnel-vision concept is not conducive to the attainment of an ideal environmental situation where man and nature can thrive in harmony with one another; and
WHEREAS, there is now an urgent need to formulate an intensive, integrated program of environmental protection that will bring about a concerted effort towards the protection of the entire spectrum of the environment through a requirement of environmental impact assessments and statements:
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:
