Data Collection and Storage

- Biometric information: Front-facing photograph, full set of fingerprints, iris scan, and other identifiable features as determined by the implementing rules and regulations (IRR). (Section 8)

Use of PhilID/PSN
- The PhilID or PSN, subject to authentication, shall be accepted as sufficient proof of identity in various transactions, including social welfare benefits, government services, passport and driver's license applications, tax-related transactions, voting, hospital admissions, school admissions, employment, banking, and criminal record verification. (Section 13)
- Proof of identity does not necessarily mean proof of eligibility for certain benefits and services. (Section 14)
- Issuance of the PSN and/or PhilID does not constitute incontrovertible proof of citizenship. (Section 14)
Implementing Agency and Coordination
- The PSA is the primary implementing agency responsible for overall planning, management, and administration of the PhilSys. (Section 15)
- The PSA will collaborate with LGUs, other government agencies, and GOCCs for registration and enrollment, including indigenous cultural communities and remote localities. (Section 15)

Data Protection and Safeguards

Penalties
- Refusing to accept or recognize the PhilID or PSN as official identification: Fine of PHP 500,000. (Section 19)
- Unlawful use of PhilID or PSN, or committing fraudulent acts: Imprisonment of 6 months to 2 years, or a fine of PHP 50,000 to PHP 500,000, or both. (Section 19)
- Submission of false information, unauthorized printing/issuance of PhilID, falsification/tampering of PhilID, unauthorized use/possession of PhilID: Imprisonment of 3 to 6 years and a fine of PHP 1,000,000 to PHP 3,000,000. (Section 19)
- Unlawful collection or use of personal data, willful disclosure of data, or unauthorized access to the PhilSys: Imprisonment of 6 to 10 years and a fine of PHP 3,000,000 to PHP 5,000,000. (Section 19)
- Malicious disclosure of data by officials/employees: Imprisonment of 10 to 15 years and a fine of PHP 5,000,000 to PHP 10,000,000. (Section 19)
- Negligence by officials/employees resulting in unauthorized access: Imprisonment of 3 to 6 years and a fine of PHP 1,000,000 to PHP 3,000,000. (Section 19)
- Additional penalties for government officials/employees, including perpetual disqualification from public office or employment. (Section 19)
Transitory Provisions and Implementation
- The PSA shall carry out the implementation in a manner that does not impede the operations of card-issuing government agencies. (Section 20)

REPUBLIC ACT NO. 11055
AN ACT ESTABLISHING THE PHILIPPINE IDENTIFICATION SYSTEM
SECTION 1. Short Title.— This Act shall be known as the "Philippine Identification System Act."
SECTION 2. Declaration of Policies.— It is hereby declared the policy of the State to establish a single national identification system referred to as the "Philippine Identification System" or the "PhilSys" for all citizens and resident aliens of the Republic of the Philippines to promote seamless delivery of service, to improve the efficiency, transparency, and targeted delivery of public and social services, to enhance administrative governance, to reduce corruption and curtail bureaucratic red tape, to avert fraudulent transactions and misrepresentations, to strengthen financial inclusion, and to promote ease of doing business. Towards this end, a resilient digital system shall be deployed to secure the data collected and ensure that the people's right to privacy, confidentiality and other basic rights are at all times upheld and protected.
