Key Components of PhilSys

- PhilSys Registry: A database maintained by the Philippine Statistics Authority (PSA) containing the PSN, registered records, and information of all registered persons. (Section 7)
- Philippine Identification Card (PhilID): A non-transferable card issued to registered persons containing their PSN, biometrics, and other personal information. (Section 7)
Registration Process
- All citizens and resident aliens must register personally at designated registration centers within one year after the law's effectivity. (Section 9)
- Registration centers include PSA offices, local civil registry offices, GSIS, SSS, PhilHealth, HDMF, COMELEC, PHLPost, and other assigned agencies. (Section 9)
- Filipinos residing abroad can register at Philippine embassies or foreign service posts. (Section 9)
- Special arrangements will be made for minors, senior citizens, persons with disabilities, indigenous persons, and those in institutional households. (Section 9)
- Mobile registrations will be conducted for remote areas. (Section 9)
- Basic documentary requirement is a birth certificate for citizens and proof of residence for resident aliens. (Section 10)
Data Collection and Storage
- Demographic data: Full name, sex, date of birth, place of birth, blood type, address, Filipino or resident alien status, marital status (optional), mobile number (optional), and email address (optional). (Section 8)
- Biometric information: Front-facing photograph, full set of fingerprints, iris scan, and other identifiable features as determined by the implementing rules and regulations (IRR). (Section 8)
- Biometric exceptions will be allowed for those unable to provide complete biometrics. (Section 8)
Use of PhilID/PSN
- The PhilID or PSN, subject to authentication, shall be accepted as sufficient proof of identity in various transactions, including social welfare benefits, government services, passport and driver's license applications, tax-related transactions, voting, hospital admissions, school admissions, employment, banking, and criminal record verification. (Section 13)
- Proof of identity does not necessarily mean proof of eligibility for certain benefits and services. (Section 14)
- Issuance of the PSN and/or PhilID does not constitute incontrovertible proof of citizenship. (Section 14)
Implementing Agency and Coordination
- The PSA is the primary implementing agency responsible for overall planning, management, and administration of the PhilSys. (Section 15)
- The PSA will collaborate with LGUs, other government agencies, and GOCCs for registration and enrollment, including indigenous cultural communities and remote localities. (Section 15)
- The PhilSys Policy and Coordination Council (PSPCC) will formulate policies and guidelines for effective coordination and implementation of the PhilSys. (Section 16)
Data Protection and Safeguards
- Unlawful disclosure, collection, recording, conveyance, dissemination, publication, or use of registered persons' information is prohibited, except with consent or court order for public health or safety reasons. (Section 17)
- The PSA, with the technical assistance of the DICT, shall implement reasonable security measures to protect the information gathered for the PhilSys. (Section 18)
- Aggregate data or statistical summaries without identifying individuals may be generated from the collected data. (Section 18)
Penalties
- Refusing to accept or recognize the PhilID or PSN as official identification: Fine of PHP 500,000. (Section 19)
- Unlawful use of PhilID or PSN, or committing fraudulent acts: Imprisonment of 6 months to 2 years, or a fine of PHP 50,000 to PHP 500,000, or both. (Section 19)
- Submission of false information, unauthorized printing/issuance of PhilID, falsification/tampering of PhilID, unauthorized use/possession of PhilID: Imprisonment of 3 to 6 years and a fine of PHP 1,000,000 to PHP 3,000,000. (Section 19)
- Unlawful collection or use of personal data, willful disclosure of data, or unauthorized access to the PhilSys: Imprisonment of 6 to 10 years and a fine of PHP 3,000,000 to PHP 5,000,000. (Section 19)
- Malicious disclosure of data by officials/employees: Imprisonment of 10 to 15 years and a fine of PHP 5,000,000 to PHP 10,000,000. (Section 19)
- Negligence by officials/employees resulting in unauthorized access: Imprisonment of 3 to 6 years and a fine of PHP 1,000,000 to PHP 3,000,000. (Section 19)
- Additional penalties for government officials/employees, including perpetual disqualification from public office or employment. (Section 19)
Transitory Provisions and Implementation
- The PSA shall carry out the implementation in a manner that does not impede the operations of card-issuing government agencies. (Section 20)
- The PSA shall gradually synchronize and consolidate all existing government-initiated identification systems into the PhilSys. (Section 20)
- An extensive information campaign shall be undertaken within 3 months after the law's effectivity. (Section 21)
- Funding for implementation shall be included in the General Appropriations Act. (Section 22)
- Implementing rules and regulations shall be promulgated within 60 days after the law's approval. (Section 23)
- The law shall take effect 15 days after its publication in the Official Gazette or a newspaper of general circulation. (Section 26)

REPUBLIC ACT NO. 11055
AN ACT ESTABLISHING THE PHILIPPINE IDENTIFICATION SYSTEM
SECTION 1. Short Title.— This Act shall be known as the "Philippine Identification System Act."
SECTION 2. Declaration of Policies.— It is hereby declared the policy of the State to establish a single national identification system referred to as the "Philippine Identification System" or the "PhilSys" for all citizens and resident aliens of the Republic of the Philippines to promote seamless delivery of service, to improve the efficiency, transparency, and targeted delivery of public and social services, to enhance administrative governance, to reduce corruption and curtail bureaucratic red tape, to avert fraudulent transactions and misrepresentations, to strengthen financial inclusion, and to promote ease of doing business. Towards this end, a resilient digital system shall be deployed to secure the data collected and ensure that the people's right to privacy, confidentiality and other basic rights are at all times upheld and protected.
