PRESIDENTIAL DECREE No. 871 January 6, 1976

PLACING PROFESSIONAL BASKETBALL GAMES AND OTHER PROFESSIONAL GAMES UNDER THE SUPERVISION AND REGULATION OF THE GAMES AND AMUSEMENTS BOARD

WHEREAS, the development, promotion and maintenance of desirable moral, social and cultural values is one of the objectives of the New Society;

WHEREAS, professional basketball has remained the most popular spectator sports in our country;

WHEREAS, there have been changes of game-fixing or point shaving and "play for play" in local basketball circles;

WHEREAS, the necessity of distinguishing clearly the status of amateurism as opposed to professionalism has given birth to the Philippine Basketball Association which seeks to establish and maintain a professional basketball league;

WHEREAS, there is urgent need for governmental supervision and regulation on the operation and conduct of professional basketball games and other professional games as well as the participants therein to insure integrity and provide ample protection to all concerned at all times;

Summary of Presidential Decree No. 871

Supervision and Regulation of Professional Basketball Games and Other Professional Games

- Vests the supervision and regulation of professional basketball games and other professional games in the Philippines to the Games and Amusements Board. (Section 1)

Powers and Duties of the Games and Amusements Board:

- Prescribe additional rules and regulations to govern the operation and conduct of professional games, subject to the approval of the Executive Secretary. (Section 2a)
- Enforce laws, decrees, executive orders, rules and regulations related to professional games. (Section 2b)
- Approve or disapprove rules and regulations issued by entities or associations related to professional games. (Section 2c)
- Exercise supervision over all officials, employees and persons connected with professional games. (Section 2d)
- Issue licenses or permits to conduct professional games and collect fees for issuance (Section 2e):
  - Professional basketball teams: ₱100.00 each annually (Section 7a)
  - Coaches: ₱50.00 each annually (Section 7b)
  - Players: ₱50.00 each annually (Section 7c)
  - Referees: ₱50.00 each annually (Section 7e)
  - Timekeepers, scorers and other licensed personnel: ₱20.00 each annually (Section 7f)
- Suspend or revoke licenses or permits for non-compliance or violations. (Section 2f)
- Order temporary suspension of licenses or permits if necessary for the best interest of the professional games. (Section 2g)
- Appoint personnel, fix their salaries, and employ consultants or experts as necessary. (Section 2h)
- Order suspension of any game in case of violations or non-compliance. (Section 2i)
- Investigate, decide and settle disputes arising out of professional games. (Section 2j)
- Designate officers to conduct hearings or investigations. (Section 2k)
- Summon parties, issue subpoenas, and require production of documents as necessary. (Section 2l)
- Inspect books, records and accounts of entities conducting professional games. (Section 2m)
- Perform other duties and exercise powers incidental or necessary for the Board's purposes. (Section 2n)

Permit Requirement:

- It is unlawful to conduct professional basketball games or other professional games without a permit duly issued by the Board. (Section 3)
- Each permit shall specify the person, entity or association, place, and date of the games. (Section 3)

License Requirement:

- No person may be employed as a player, referee, scorer, timekeeper or other duties connected with professional games unless duly licensed by the Board. (Section 4)
- Licenses are obtained yearly and may be withdrawn or revoked for dishonest or fraudulent practices, violations, or just cause. (Section 4)

Assignment of Officials:

- The Board shall assign duly licensed officials, referees, timekeepers, scorers and other officials to officiate at each professional game. (Section 5)
- Only the officials designated by the Board shall have authority to perform their respective functions. (Section 5)

Duties of Entities Conducting Professional Games:

- Maintain peace and order in the premises where the games are conducted. (Section 6)
- Ensure proper observance of rules and regulations governing the games. (Section 6)

Admission Receipts and Other Income:

- The Board shall supervise the sale of admission tickets for professional games. (Section 8)
- Tickets shall state the price, name of the entity conducting the games, team names, and date printed plainly. (Section 8)
- Ticket prices or game dates shall be subject to the Board's approval. (Section 8)
- Entities conducting professional games shall remit to the Board:
  - 3% of gross gate receipts and income from television, radio and motion picture rights, if any. (Section 8)
  - Exception: Professional basketball games conducted by the Philippine Basketball Association shall only be subject to 5% amusement tax on gross receipts from ticket sales. (Section 8)

Civil Service Law and WAPCO Coverage:

- Appointments to positions related to supervision and regulation of professional games shall be subject to Civil Service Laws and rules. (Section 9)
- However, such positions shall be exempted from the coverage of the Wage and Position Classification Office. (Section 9)

Appeals:

- Orders, rulings and decisions of the Board on matters connected with or arising out of basketball may be appealed to the Office of the President within 72 hours from receipt. (Section 10)
- The decision of the President shall be final. (Section 10)

Forfeiture of Sums Paid to the Board:

- All sums paid to the Board in payment of license or permit fees shall be deemed forfeited upon cancellation or revocation of such license or permit. (Section 11)

Separability Clause:

- If any provision of this decree is declared unconstitutional, it shall not invalidate the other provisions. (Section 12)

Repealing Clause:

- Any law, decree, executive order or administrative order or regulations inconsistent with this decree are hereby repealed or modified accordingly. (Section 13)

Effectivity:

- This decree shall take effect immediately. (Section 14)
