Providing For New Guidelines For the Processing of Applications For Port Zone Delineation

Executive Order No. 410

EXECUTIVE ORDER NO. 410 July 3, 1990

PROVIDING FOR NEW GUIDELINES FOR THE PROCESSING OF APPLICATIONS FOR PORT ZONE DELINEATION

WHEREAS, Section 2, Article 11, of Presidential Decree No. 857, provides that:

"Declaration of Policies and Objectives

It is hereby declared to be the policy of the State to implement an integrated program for the planning, development, financing, and operation of Port or Port District for the entire country in accordance with the following objectives:

c. To promote regional development through the dispersal of industries and commercial activities throughout the different regions.

e) To redirect and reorganized port administration beyond its specific and traditional functions of harbor development and cargo handling operations to the broader functions of total port district development, including encouraging the full and efficient utilization of the Port's hinterland and tributary areas."

WHEREAS, Sec. 5, Article IV, of Presidential Decree No. 857, further states that:

"Port District. The Authority may, from time to time submit to the President through the National Economic and Development...

Summary of Executive Order No. 410

Objectives and Policies
- To promote regional development through dispersal of industries and commercial activities (Sec. 2(c), Art. II, PD 857)
- To broaden port administration functions to include total port district development, encouraging efficient utilization of hinterland and tributary areas (Sec. 2(e), Art. II, PD 857)

Port District Declaration
- The Philippine Ports Authority (PPA) may submit applications for declaring specific areas as Port Districts, accompanied by a survey plan indicating geographical location and boundaries (Sec. 5, Art. IV, PD 857)

Participation of Regional Development Councils (RDCs)
- RDCs may participate in reviewing and processing applications for port zone delineation to align with regional development plans (Whereas clause)

Processing of Port Zone Delineation Applications
- PPA shall consult local government officials and concerned RDC before conducting detailed surveys (Sec. 2(a))
- Application shall be accompanied by:
    (i) Development program for port facilities, including project components, locations, and basis (e.g., master plans, feasibility studies) (Sec. 2(b)(i))
    (ii) Inventory of existing land use and ownership status of areas under consideration (Sec. 2(b)(ii))
- RDC shall review consistency of documents and data in the application with implementing rules and regulations (Sec. 2(c))

Approval Process
- Applications jointly recommended by PPA and RDC shall be submitted directly to the Office of the President (Sec. 3)
- If conflicts occur between PPA and RDC, issues shall be forwarded to NEDA Infrastructure Committee for resolution before submission to the Office of the President (Sec. 3)

Implementing Rules and Regulations
- NEDA Infrastructure Committee is authorized to promulgate implementing rules and regulations (Sec. 4)

Effectivity
- The Executive Order shall take effect immediately (Sec. 5)
