Presidential Decree No. 632

PRESIDENTIAL DECREE No. 632 January 6, 1975

PROVIDING FOR THE BUDGETARY ADMINISTRATION OF THE INTEGRATED POLICE FORCES

WHEREAS, pursuant to Presidential Decree No. 421, dated March 21, 1974; No. 482, dated June 13, 1974; No. 531, dated August 8, 1974; and No. 585, dated November 18, 1974, administrative control and supervision over the city and municipal police and fire departments and jails therein covered, including their personnel, funds, property, equipment, and other resources, shall be transferred to the Philippine Constabulary after one year, but not later than two years, from the promulgation of the aforesaid Decrees;

WHEREAS, pursuant to the aforementioned Presidential Decrees, operational control over the Metropolitan Police Force and the Provincial Integrated Police Forces therein established has been transferred to the Philippine Constabulary from the promulgation thereof;

Summary of Presidential Decree No. 632

Funding of Integrated Police Forces
- Cities and municipalities shall include 18% of their annual regular income in their budget as contribution to the National Government for maintenance and operation of the Metropolitan Police Force and Provincial Integrated Police Forces. (Section 1)
- Annual regular income excludes budgetary aids, subsidies, bond proceeds, loan proceeds/repayments, private contributions, sale of assets, prior year adjustments, and non-recurring receipts. (Section 1)
- Failure to provide full appropriation allows the Secretary of Finance or Provincial Treasurer to declare the city/municipal budget inoperative. (Section 1)
- The city/municipality must set aside the necessary appropriation in a supplemental budget, or the Secretary of Finance may withhold the amount from internal revenue allotments. (Section 1)

Remittance of Contribution
- The city or municipal treasurer shall remit 1/12 of the annual contribution to the Treasurer of the Philippines within 10 days after each month. (Section 2)

Absence of Approved Annual Budget
- In the absence of an approved budget, the treasurer shall remit an amount equal to the previous year's contribution until the new appropriation is determined. (Section 3)

National Annual Budget
- The National Government shall include necessary sums in its annual appropriations for the operation and maintenance of the Metropolitan Police Force and Provincial Integrated Police Forces, including amounts to cover any deficiency in local contributions. (Section 4)

Appropriation
- Additional funds are appropriated from the National Treasury for the implementation of the police integration decrees, including personnel services, maintenance, transportation allowances, vehicles, equipment, and capital outlay. (Section 5)

Book of Accounts
- The Chief of Constabulary is authorized to maintain and administer a separate book of accounts for the Metropolitan Police Force and Provincial Integrated Police Forces with the approval of the Secretary of National Defense. (Section 6)

Annual Report
- The Chief of Constabulary shall submit an annual report on the activities and accomplishments of the Metropolitan Police Force and Provincial Integrated Police Forces to the President within 30 days after the end of each calendar year. (Section 7)

Penalty Clause
- Failure to provide the appropriation or make the required remittance, and any other violation of the provisions of this Decree shall be punished in accordance with the police integration decrees. (Section 8)

Rules and Regulations
- The Chief of Constabulary may promulgate rules and regulations for the effective implementation of this Decree with the approval of the Secretary of National Defense. (Section 9)
- The Secretary of Finance shall promulgate rules and regulations for the proper implementation of Sections 1, 2, and 3 of this Decree. (Section 9)

Repealing Clause
- All laws, decrees, orders, and instructions inconsistent with this Decree are repealed or modified accordingly. (Section 10)

Effectivity
- This Decree shall take effect upon approval. (Section 11)
